WASNINGTON <br />hearings before both the Planning Commission and the City Council. <br />RCN 58.17.020(1) defines a subdivision as follows: <br />"'Subdivision' is the division of land into five or more <br />lots, tracts, parcels, sites or divisions for the purpose <br />of sale Pr lease and shall include all resubdivision of land." <br />It is my opinion that the redividing of property so that the end result <br />would be the creation of five or more lots would constitute the subdivision of land. <br />The position is strenjilhened by the fact that this type of subdivision is not <br />exempted from the application of RCIV 58.17 by RCN 58.17.040. Thus, it can be <br />presumed 'that the legislature did not intend to en cept the above land division <br />from the operatics of RCN 58.17 (See AGO 1971 No. 17 and Spokane vs. The State, <br />198 Nash. 682 (1g39). — <br />On the basis of tl is reason, it is my opinion that the divisio:: or segregation <br />of four adjacent lots so as to create eight lots would fall under the purview <br />of RCN 58.17 anO thus require formal platting. <br />If you have any comments or questions regarding this matter, I would be happy <br />to discuss this further with you at your convenience. <br />AJII/bi <br />J. r- <br />
