The p�'?posed <br />structure will extend eleven feei. beyond <br />the top of slope (see attached site plan). <br />FINDINGS: <br />1. The applicant has requested that the Planning Director <br />permit a slope/stream buffer modification for the <br />construction of a single family residence at 4816 Harbor <br />Lane, Everett, Washington. <br />2. A soils (Geotechnical) report dated March 1990 and site <br />plan have been submitted to the City Planning Department as <br />required by Section 37.080 of the Everett Zoninq Code. The <br />majority of the site slopes more than twenty-fiYe percent <br />3. The site exhibits characteristics identified in subsection <br />37.040 (A-L) Everett Zoning Code a� environmentally <br />sensitive. The specific characteristics are: <br />a. The slope is in the Merrill & R�ng Creek drainage. <br />b. The toe of the slope (>250) is within 25 feet of the <br />top of the stream bank. <br />4. The soils report demonstrates through specific findinqs, <br />conclusions and recommendations that the criteria listed in <br />subsection 37.080.0 of the Everett Zoning Code are met: <br />a. The soils report proposes construction methods that <br />reduce erosion, landslide, or seismic activity <br />potential and improve or not adversely affect the <br />stability of the slope. <br />b. The proposal will use construction techniques which <br />minimize disruption of existing topography and natural <br />vegetation. <br />c. The proposal addresses the existing geological <br />constraints of the site, including so:ls and hydrology. <br />d. The proposed development does not endanger adjoining <br />properties, the steep slope hazard area or be <br />endangered by i.ts proximity to the steep slope hazard <br />area. <br />The soils report is made a part of this permit by reference. <br />5. The site has been logged Uy the applicant witltout City <br />approval. The logged area extends Prom the north property <br />line down slope beyond the distinct break in slope to within <br />100 feet of the creek's top-of-bank. <br />
