The application is for a waiver of ti-e twenty-five foot <br />slope/stream buffer requirement to allow for reasonable use <br />of tlie subject property. <br />2. The Planning Director is authorized to waive or modify the <br />slope/stream buffer requirement using review process II.B if <br />the applicant demonstrates that the proposal meets the <br />criteria listed in subsections 37.080.0 and 37.160.D.3 of <br />the Everett Zoninq Code. <br />3. The applicant's soils report supports the proposed building <br />setback on the site and recommends speciPic actions be taken <br />that satisfy criteria requirements. <br />4. Implementation of the soils report recommendations for <br />construction and post-construction activity will protect the <br />environmentally sensitive feature and allow for reasonable <br />use of the property. <br />5. The logging of the site is in violation of Section 37 of the <br />Everett Zoning Code. SuUsection 37.200 establishes the <br />enforcement, violation and penalty provisions that apply to <br />all violations of Section 37, Environmentally Sensitive <br />Areas. <br />DECISION: <br />A waiver of <br />is approved <br />on the site <br />made in the <br />permit: <br />the twenty-five foot slope/stream buffer requirement <br />for the proposed construction in the location shown <br />plan subject to implementation of all recommendations <br />soils report and the followinq requirements of this <br />1.
