Box 5397 <br />Everett, WA 98206 <br />hereinafter referred to as "Applicant�" for a variance from E.M.C. <br />19.12.050(A) Front Yards, to allox: <br />coustruction of a single family residenee that would be 45 feet from <br />the centerline of Harbor Lane instead of the 55 feet required by Code. <br />on t!ie Polloxing described property <br />See E�thibit "A" <br />conmonly lmown as: west side of Harbor Lane, south of 49th St. S4i <br />Y'he Board of Ad�ustment, folloxing a publie hearing on said application held <br />on Ootober 6, 1986 and further having ravierred all testimony, makes the <br />;ullowing Findings, Conolusions and Order: <br />FINDINGS AND CONCLUSIONS: <br />1. That there have been exeeptional or extraordinary eircumstanees or <br />conditions applying to the subjeet property or as to the intended use <br />thereof that do not apply generally to other properties in the same <br />vicinity or zone. <br />Pa <br />Finding: All of the lots in the vicinity of this lot have viexs of <br />Puget Sound. The viex from this lot as xell as the lot i�ediately <br />to the south is in the northwesterly direation. In order not to <br />block the view of the house to the south, this house needs to be <br />located as close as possible to Harbor lana. In addition, even <br />though the lot is 100 feet x 400 feet, only about one-third of sueh <br />area is actually "buildable" in that the terrain drops dramatically <br />into a gully. To take advantage of the vieW and to build a home that <br />"conforms" to the terrain, it is necessary to build the home as <br />delineated on the attached plot plan. <br />Canclusion: There are exceptional and extraordinary circumatances <br />and conditions applying to the praperty that do not generally. <br />That sueh variance is necessary for the preservation and enjoyment of <br />a substantial property right of the appellant possessed by the owners <br />of other properties in the same vicinity or zone. <br />Find3ng: The varianee is necessary to allox construction of a home <br />that takes advantagA of the besutiful view. In addition, the <br />varianae is necesssry in order to protact and/or not bloek the view <br />of the property oNners o�rning the adjacent lot to the south. Because <br />the viea is to the northaest, the home if "pushed to the west^ would <br />block their view. <br />Conelusion: The varianee is necessary for the preservation and <br />enjoyment of a property right possessed by other ormers in the same <br />vicinity. <br />
