Staff has conditioned the project so that the yard extension requested <br />under this reasonable use is limited to the top of slope which minimizes sediment <br />impacts to the downslope wetland and stream areas. The reduced house setback will <br />not result in any increased geologic hazards based on the findings ot the geotechnical <br />report and has therefore been mitigated to the maximum extentpo ssible. Additionally, <br />recommendations have been provided for the proposed development which should <br />minimize any other potential environmental impacts. These recommendations as <br />detailed in the report prepared by Geotechnical and Environmental Services dated <br />November 24, 1995, are beinq required as conditions of approval for the proposed <br />residence. However, the placement of fill on the steep slope area in order to provide <br />the extended 50 foot yard area east of the residence exceeds the provisions for <br />reasonable use of the property based on surrounding uses and also creates impacts to <br />the slope and wetland that are unmitigatable and therefore will not be permitted. <br />I I N: The constn�ction of the proposed residence adjacent to the steep slope area on <br />! e eastem portion of the subject property is permitted subject to the conditions listed below. <br />However, the placement of fill material on the slope area for the extended 50 foot yard area is <br />not permitted. <br />� <br />Fill up to the top of slope as flagged by City Staff on October 6, 1995 for creation of a <br />backyard area and placement of the house as staked in the field, ranging from 15 feet <br />for the southeast comer and 28 teet for the northeast comer from the top of slope, shall <br />be permitted. <br />Prior to initiating or issuance of any clearing, grading or building pertnits, the flagged <br />top of bank and house location must be revisded by the Applicant and City Staff. <br />3. Strict compliance with all recommendations as stated <br />geological repoR by Geotechnical & Environmental Services, <br />Everett, WA 98206, dated November 24, 1995, is required. <br />in the geotechnical and <br />Inc. (GES), PO Box 1031, <br />4. A letter from Geotechnical & Environmental Services, Inc stating that the plans <br />submitted for building pertnits complies with all conditions and recommendations stated <br />in their geotechnical and geological report dated November 24, 1995, must be provided <br />prior to issuance of building permits. <br />5. A landscaping plan showing approximate planting locations, rypes and size of plantings <br />to be used for slope stabiliry and revegetation of all other disturbed areas as a result of <br />construction must be approved by the Planning Department prior to issuance of <br />building permits. <br />The applicant or an owner of property located within 300 feet of the subject property may <br />appeal the Planning Director's determination as to whether to allow the proposed sde <br />improvements. My such appeal must be filed within ten (10) calendar days of the date <br />specified below. Appeal forms are available from the Planning Department and must be filed <br />with the required filing fee.
