• <br />C� <br />PLANNING DIRECTOR DETERMINATION <br />Review Process 11 E13-98 <br />INTRODUCTION: The City of Everett Planning Department received an application from <br />Kathy Sedy, 11511 Marino Ave, Everett, WA 98204 for an approximately 10 foot by 20 foot <br />two story addition to the existing single family residence which is located only 3 feet from the <br />north side property line. The new addition will have the same setback from this north side <br />property line as the existing house. The existing residence was originally constructed in 1910 <br />and has been certified as a legal non -conforming structure. Section 38.040 allows for the <br />Planning Director to permit the expansion of a structure which does not meet required <br />setbacks or height, provided that the expansion does not make the setback or height more <br />nonconforming; that the expansion complies with all other requirements of the zoning code <br />ordinance; and that the nonconformity has been certified by the Planning Department. <br />BACKGROUND: The property is located in the R-2, Single Family Residential Zone. The <br />typical required setbacks from the side property line is 5 feet. The existing residence is <br />located only 3 feet from the north side property line. It was originally constructed in 1910 <br />according to the Snohomish County Assessor's records. The zoning code requirement for a <br />minimum 5' building setback for structures from a side property line became effective <br />December 31, 1956. <br />FINDINGS: The existing residence does not meet the required 5 foot setback from the north <br />side property line. This structure's setbacks have been certified as legal nonconforming <br />setback (NCB #13-98). The applicant proposes to add on to the residence with the same <br />setbacks from the north property line with no further encroachment. <br />DECISION: The Planning Director has determined to allow for the proposed addition <br />with the following conditions: <br />Necessary building permits are to be obtained from the City of Everett's Building <br />Department prior to construction. <br />Right to Appeal: The applicant or ownar of property located adjacent to the subject property <br />or any property owner who deems himself aggrieved and will thereby suffer a direct impact <br />from the proposal may appeal the Planning Director's determination as to whether or not the <br />proposal should be permitted. Any such appeal must be filed within fourteen (14) calendar <br />days of the date specified below. Appeal forms are available from the Planning Department <br />and must be submitted along with the required filing fee.
