That there are exceptional or extraordinary circumstances or conditions <br />applying to the subject property or as to the intended use thereof, that do <br />not apply generally to other properties in the same vicinity or zone, specifically: <br />a) Most two -parcel properties at 50x 120 in the vicinity whereas <br />applicants property is 50 x 148 due to a partial vacation of <br />the former Parkhurst Ave. <br />2. That such variances is necessary for the preservation and enjoyment of a <br />substantial property right of the appellant possessed by the owners of other <br />properties in the same vicinity or zone, specifically: <br />a) That property owners with 7500 square feet are entitled to two <br />duplex units or one unit per 3750 sq. ft. whereas the appellant <br />wishes two units on 7400 sq. ft. or 3700 sq. ft. per unit. <br />3. That the authorization of such variance will not be materially detrimental <br />to the public welfare or injurious to property in the vicinity or zone in <br />which the property is located, specifically: <br />a) The variance is minor and will have no greater impact than a similar <br />structure on 7500 sq. ft. <br />4. That the granting of such variance will not adversely affect the comprehensive <br />general plan. <br />
