CITY OF EVERETT - BOARD OF ADJUSTMENT <br />ORDER <br />WHEREAS, theretofore, there was filed with the City of *cerett Planning <br />Department on (date) April 8, 1975 an application for a variance of Section No. <br />.090 of Everett City Code No. 15.04 by (applicant) William and Joanne Love <br />(iddress) 19412 68th Avenue Lynnwood, Washingtcn 98036 <br />for (specific variance requested) <br />Permission to construct a duplex on a 7400 square foot lot which <br />has a minimum requirement of 7500 square feet. <br />on the following described property: <br />Lots 15 and 16 plust 28 feet of vacated Parkhurst Block <br />533 Mitchell Land and Improvement Company South First Addition <br />address: 2401 Harrison <br />AND: WHEREAS, (date) May 5, 1975 was fixed as the date of hearing on said appli- <br />cation and proper notice having been given as required by law, <br />AND, WHEREAS, a public hearing was held on said date and the Board of Adjustment, <br />after reviewing all testimony, made the findings that: <br />1. There are exceptional or extraordinary circumstances or conditions <br />applying to the subject property or as to the intended use thereof, <br />that do not apply generally to other properties in the same vicinity <br />or zone, specifically: <br />a. Most two -parcel properties are 50 x 120 in the vicinity <br />whereas applicants property is 50 x 148 due to a partial <br />vacation of the former Parkhurst Avenue <br />2. That such variance is necessary for the preservation and enjoyment <br />of a substantial property right of the appellant possessed by the <br />owners of other properties in the same vicinity or zone, specifi- <br />cally: <br />a. That property owners with 7500 square feet are entitled <br />to two duplex units or one unit per 3750 square feet <br />whereas the appellant wishes two units on 7400 square <br />feet or 3700 square feet per unit. <br />3, That the authorization of such variance will not be materially <br />detrimental to the public welfare or injurious to property in the <br />vicinity or zone in which the property is located, specifically: <br />a. The variance is minor and will have no greater impact <br />than a similar structure on 7500 square feet. <br />4. That the granting of such variance will not adversely affect the com- <br />prehensive general plan. <br />NOW, THEREFORE, based on the foregoing findings: <br />BE IT ORDERED BY THE CITY OF EVERETT BOARD OF ADJUSTMENT that said application <br />be GRANTED. <br />AND: BE IT F114ALLY ORDERED that a copy of this written order be transmitted <br />to the applicant for their information. <br />DATE OF ACTION: May 5, 1975 <br />Reid H.
