FINDINGS AND CONCLUSIONS: <br />Criterion No. 1: <br />at tfih Re 'variance is necessary because of exceptional or extraordinary <br />circumstances regarding the size, shape, topography, or location of the <br />subject property; or the location of a pre-existing improvement on the <br />subject property that conformed to the zoning code in effect when the <br />improvement was constructed. <br />a. Findinar. The applicant states that the variance is needed <br />because the shape of the lot does not allow for curreLit <br />setback requirements on all four sides. The backside of the <br />property is unable to conform to the current requirements <br />due to the I-5 right-of-way. <br />b. Conclusions:. The subject property is a unique site that is <br />trtang�u a shape rather than a typical lot configuration. <br />The south end of the triangle shape provides for the deepest <br />portion of the lot which is 69 feet then tapering down to 34 <br />feet at the =Lh end of the lot. <br />Once the standard zoning code setbacks of 20 feet from the <br />front and rear property lines and 5 feet from the side <br />property lines is applied only a very shallow and unusable <br />building site is left. <br />Criterion No. 2• <br />That the Te will not be materially detrimental to the property in the <br />area of the subject property or to the City as a whole. <br />a. Findin .. The applicant states that to the backside of the lot <br />is r ered by Interstate 5 and that allowing the proposed <br />variance will not be detrimental to the property in the area or <br />the City as a whole. <br />b. Conclusions: The City provided written notice to all <br />property owners within 300 feet of the subject site and no <br />adverse comments were received. The City's Building <br />Department reviewed the proposal and commented that a <br />building permit, public works permit and parking is required <br />for the proposal. <br />Criterion No. 3: <br />That the variance will only grant the subject property the same general <br />rights enjoyed by other property in the same area and zone as the subject <br />property. <br />a. Findings: The residence located at 2412 Harrison Avenue <br />imm iately south of the subject property is setback only 7 2/y <br />feet from the rear property line. The applicant is requesting <br />the same setback for the subject property. <br />
