REQUEST: <br />The North Congregation of Jehovah's ���itnesses has received a Special Property <br />Use Permit from the City to construct a church at 26th R Suminit, One item <br />beyond the jurisdiction or the City Council was the proposed front yard <br />setback from Harrison Street which the applican' would like to have set at <br />fourteen (14) feet rather than tha required twe ty (20) feet. This one element <br />was referred to the Board of Adjustment. <br />II. ARGUMENTS IN FAVOR: <br />A. The setback reduction is necessary to allc the desired 200 seat capacity <br />for the church while :til! providing nece�sary parking and I:+ndscapinq <br />improvements. <br />B. The desiyners have at�empted othar site confi�urations and this is the only <br />one which will accomplish thc. ne::ds of the church and the City. <br />C. Of the totai I00 feet of frontage of Harrison Streei the reduced setback <br />would on.y be in affect for �� distanca of 45 feet. <br />D. Corner lots require a minimum 20 foot front yzrd and 10 foot side yard <br />setback. This situation actually exist; on ihis property, i�ut in reverse <br />with the side yard, facing 26th Street, havin3 a 35 foot sei'back and the <br />front yard having a 14 foot setbacl<. <br />III. ARGUF4ENTS AGAINST: <br />A. The residence to the north which will lie approximately thirteen feet <br />irom the church is setback approximately 20 feet from the property line <br />IV. �UESTIONS: <br />None. <br />V. POSSIBLE FINDINGS: <br />A. That there are exceptional or Pxtraordinary circumstances or conciitions <br />applying to the s�bject property or as to the intended use thereof that <br />do not apply generally to other properties in the same vicinity or zone <br />spe�ifically: <br />That the proposed structure is a church permitted by <br />Speciai Property Use Permit in the residential area. <br />7_. That the proposed s�ructure is on a corner lot and meets <br />the setback requirements for such lots, except that ihe <br />greatest sethack i, on the side yard facing 76th Street <br />and the lesser setback is on the front yard facing Harrison <br />Street. <br />
