That there are exceptional or extraordinary circum- <br />stances or conditions applying to the•subject pro- <br />perty or as to the intended use thereof that do not <br />apply generally to other properties in the same <br />vicinity or zone, specifically: <br />1. Thak the proposed structure is a church <br />permitted by Special Property Use Permit <br />in the residential area. <br />2. That the proposed structure is cn a corner <br />lot and meets the setback requirements for <br />such lots, except that the greatest setback <br />is on the side yard facing 26th Street and <br />the lesser setback is on the front yard facing <br />Harrison Street. <br />B. That such variance is necessary for the preservation <br />and enjoyment of a substantial property right of the <br />appellant possessed by the owners of other praperties <br />in the same vicinity or zone, specifically: <br />1. That the variance would allow for an occu- <br />pancy of 200 persons which is the desired <br />standard of the church. Denial of the <br />variance would reduce the church's ability <br />to meet this demand. <br />_ C. That the authorization of such variance will not be <br />materially detrimental to the public welfare or injuri- <br />ous tu property in the vicinity or zone in which the <br />property is located, specifically: <br />1. That the net affect <br />as pzoposed would be <br />building technically <br />which had a ten foot <br />of the structure situated <br />no different than a <br />fronting on 26th Street <br />setback from Harrison. <br />D. That the granting of such variance will not adversely <br />affect the Comprehensive General Plan, specifically: <br />1. That the Planning Commission in approving <br />the proposed facility has implied conformaiice <br />with the purpose and intent of the general <br />plan and Zoning Code. <br />A hearing was held on the request of Robert O'Connor, 1415 84th <br />Street; Space 102; �verett, Washington, for a variance from Section <br />15.05.110 (Zoning Ordinance) Paragraph C, Dfinimum lot size and width <br />for permission to construct a ten (10) unit apartm��nt on property <br />� that requires 7500 square feet and is 221 feet short of the square <br />t <br />footage that is required. <br />� Legal Description: Lots 15 and 16, Block 2; Climax Land Company's <br />First Addition, Less the West 7.5 feet. <br />Address: 3829 Colby Avenue <br />
