WHEREAS, the City Council further finds that: <br /> 1. The applicant, Housing Hope, owns the .4 acre property located on a portion of the <br /> property located at 5830 Evergreen Way in Everett, as depicted in exhibit "A"; and <br /> 2. Housing Hope desires the change in zoning from R-2 to B-2 in order to place an <br /> educational facility on the subject property along with housing; and <br /> 3. The B-2 Zone regulations could lead to a wide range of uses that could negatively affect <br /> nearby residential areas if applied to the subject property; and <br /> 4. Input by the Planning Commission and the affected neighborhood group indicates a <br /> desire to allow the proposed housing and educational center, prohibit other B-2 uses of the site, <br /> assure continued residential use along Fleming Street and limit access to the subject site from <br /> Evergreen only (not Fleming Street); and <br /> 5. Housing Hope and the City desire to implement this proposed rezone through the City's <br /> non-project rezone process and a Development Agreement as provided in Chapter 41, Subsection <br /> 41.160D of the Zoning Code; and <br /> 6. The proposed rezone, when combined with certain conditions, of the subject property is <br /> consistent with the Everett Comprehensive Plan; and <br /> 7. The public health safety and welfare will be provided for by the proposed rezone through <br /> the use of a Development Agreement; and <br /> WHEREAS, the City Council concludes: <br /> 1. The requested rezone of the property from R-2 to B-2 is consistent with the intent of the <br /> City's Comprehensive Plan so long as nearby residential areas are protected; and <br /> 2. The rezone proposal is consistent with Chapter 41, Subsection 41.160D of the Zoning <br /> Code; and <br /> 3. The proposal by and of its self will not have any significant impacts on the environment, <br /> subsequent development will receive separate project specific SEPA/NEPA review ; and <br /> 4. The proposed zone change from R-2 to B-2 for this property bears a substantial relation <br /> to public health, safety and welfare and it promotes the best long term interests of the Everett <br /> Community; and <br /> 6. The proposed rezone shall be implemented through a Development Agreement as <br /> provided in RCW 36.70B.170; <br />
