RESOLUTION NO. 5167 b � <br /> A RESOLUTION by the City Council adopting <br /> findings, conclusions and decision determining that the <br /> proposed Initiative Petition is invalid, exceeds the scope <br /> of the initiative power and not refer the invalid <br /> ordinance to the County Auditor <br /> RECITALS <br /> WHEREAS, the City Council determined that it is in the best interests of the city of <br /> Everett and its citizens to take advantage of the provisions of chapter 35.57 RCW by forming <br /> the Everett Public Facilities District("PFD") on March 15, 2001 to finance, design, <br /> construct, operate and maintain a Regional Center; <br /> WHEREAS, the City Council by Resolution passed on August 1, 2001, concurred in <br /> the PFD's selection of the Hewitt Avenue Site as the most suitable site for the development <br /> of the Regional Center; <br /> WHEREAS, a petition to "Eliminate Hewitt Avenue Sites from Consideration for a <br /> Regional Center" ("Petition")was filed with the City Clerk on February 8, 2002, and <br /> forwarded to the Snohomish County Auditor for review of signatures on or before February <br /> 11, 2002; <br /> WHEREAS, the Snohomish County Auditor certified the sufficiency of the signatures <br /> on the Petition on February 18, 2002, and forwarded the Petition to the City Clerk for further <br /> review; <br /> WHEREAS, the Clerk forwarded the Petition to the Council, and advised the City <br /> Council that a question exists as to whether the Petitions were properly circulated and <br /> whether the Petitions are sufficient as a matter of form; <br /> WHEREAS, the City of Everett, through the adoption of its home rule Charter, and in <br /> accordance with the Washington State Constitution, Article XI, Section 10,has provided the <br /> powers of initiative and referendum to its citizens; <br /> WHEREAS, the City Council fully supports the right of the citizens of Everett to <br /> exercise the powers of initiative and referendum provided in the Charter when such rights are <br /> exercised in accordance with the scope afforded such rights under applicable state law and <br /> judicial precedent; <br />
