WHEREAS, the PFD has filed a lawsuit against the City of Everett to prevent the <br /> City from taking action on the Petition because the PFD believes that the Petition exceeds the <br /> scope of the initiative power; <br /> FINDINGS <br /> Based upon the information before it relating to the proposed Regional Center, the <br /> City Council makes the following findings: <br /> 1. On May 4, 1999, the Governor of the State of Washington signed and filed <br /> with the Secretary of State Chapter 165, Washington Laws, 1999, authorizing cities to create <br /> public facilities districts for the purpose of developing "regional convention, conference, or <br /> special events centers," and providing funding for such development through the use of <br /> previously authorized sales and use taxes as long as construction is commenced before <br /> January 1, 2003. <br /> 2. On May 30, 2000, after interviewing a strong field of qualified firms, the City <br /> entered into a professional services agreement with Brailsford & Dunlavey to conduct an <br /> extensive feasibility study for a proposed Regional Center in Everett. <br /> 3. Throughout the remainder of 2000, Brailsford&Dunlavey distributed 5,000 <br /> detailed questionnaires to Everett area residents and conducted focus sessions and interviews <br /> with residents and businesses to consider five potential sites for the Regional Center. <br /> 4. Throughout 2000 to the present, the Mayor, City staff, and once formed, <br /> representatives of the PFD, made presentations about the Regional Center to a variety of <br /> local groups, service clubs, neighborhoods, and advisory groups. <br /> 5. In January, 2001, the City obtained from Brailsford &Dunlavey and its <br /> subconsultant, Ellerbe Becket, a feasibility study which demonstrated that development of a <br /> Regional Center for the City of Everett is feasible and desirable and recommended the Hewitt <br /> Avenue Site as the preferred site and recommended a hockey team as the anchor tenant. <br /> 6. On January 24, 2001, the City appointed a 15-member Citizens Committee to <br /> evaluate the Brailsford & Dunlavey feasibility study, take public comment, and to report <br /> back to the Mayor and Council,which it did on March 5, 2001. <br /> 7. On February 26, 2001, the City entered into a professional services agreement <br /> with Perteet Engineering, Inc. to study the traffic and parking impacts of a Regional Center <br /> within the City of Everett. <br /> 8. On March 7, 2001,by Resolution No. 5019, the City Council accepted the <br /> Special Events Center Feasibility Committee Report. <br /> S:IIIles\WINWORD\resolution re.initiative.doc <br /> 2 <br />
