27. On December 20, 2001, the City, the Everett PFD, Snohomish County, and <br /> the Snohomish County PFD entered into an Interlocal Agreement for the development of the <br /> Regional Center at the Hewitt Avenue Site which: committed the parties to a timeline for <br /> commencement of construction by March 1, 2002; committed the City to complete <br /> acquisition of and lease of the Hewitt Avenue Site to the PFD; committed the County PFD to <br /> support the debt service on not less than$7 million for the development of the Regional <br /> Center; and committed the County to enter into a lease for the PFD's use of the existing and <br /> proposed future County parking garages in the vicinity of the Hewitt Avenue Site for <br /> Regional Center events. <br /> 28. On December 18, 2001, the Hearing Examiner issued a decision granting a <br /> special use permit and a height variance for the proposed Regional Center at the Hewitt <br /> Avenue Site. No appeal of the Hearing Examiner's decision was made. <br /> 29. On February 13, 2002, after lengthy negotiations with the PFD, the City <br /> Council approved Ordinance No. 2587-02, authorizing an Interlocal Financing Agreement <br /> with the PFD that sets forth the terms and conditions under which the PFD will finance, <br /> design, construct, operate, and maintain the Regional Center at the Hewitt Avenue Site with <br /> the assistance of the City. <br /> 30. On February 13, 2002, after lengthy negotiations with the PFD, the City <br /> Council authorized a Ground Lease between the City and the PFD whereby the City leases <br /> the Hewitt Avenue Site to the PFD for construction and operation of the Regional Center for <br /> a term not to exceed thirty(30) years,pursuant to the rental obligations set forth in the Lease, <br /> with the City's right, at termination, to take title to the Regional Center without payment of <br /> additional consideration. <br /> 31. On February 13, 2002, in response to citizen comment on the impacts of the <br /> Regional Center at the Hewitt Avenue Site,the City Council adopted Resolution No. 5156, <br /> authorizing the expenditure of up to $6 million dollars to redesign the façade of the Regional <br /> Center, to add public space to the Regional Center, and to accomplish other design changes at <br /> the Regional Center. <br /> 32. To date, the City has advanced approximately$700,000 for consultant and <br /> professional fees, studies and other expenses associated with the development of the <br /> Regional Center and spent in excess of$12 million for the acquisition of properties and the <br /> relocation of businesses at the Hewitt Avenue Site. <br /> 33. The PFD has,pursuant to RCW 35.57.040(1)(d) and RCW 82.14.390, made <br /> arrangements to secure for the PFD the transfer of sales and use taxes that would otherwise <br /> be paid over to the Washington State Department of Revenue so that such funds can be used <br /> for the development of the Regional Center. <br /> S:\JIles\WINWORD\resolution re.initiative.doc <br /> 5 <br />
