displacement of people,businesses and buildings, the benefits of the Regional Center to the <br /> community, and the public interest and welfare, also selected the Hewitt Avenue Site as the <br /> best site for development and construction of the Everett Regional Center. <br /> 20. On August 15, 2001,by Ordinance No. 2528-01, the City Council authorized <br /> the condemnation, acquisition and appropriation of the remaining real property and <br /> easements necessary for the purpose of constructing the Regional Center on the Hewitt <br /> Avenue Site. No referendum was initiated to challenge the Ordinance. <br /> 21. In September, 2001,Design-Build proposals including models were put on <br /> public display in the PFD offices and in the Everett Performing Arts Center, with <br /> advertisements and notices about the displays, and the 22-member citizen board appointed by <br /> the PFD recommended the preferred design. <br /> 22. On September 18, 2001, the Western Hockey League Board of Governors <br /> approved a franchise for Everett on the condition that the Regional Center be available for <br /> use by September of 2003. <br /> 23. On October 24, 2001, the City of Everett, as landowner, and the PFD, as <br /> project developer, submitted an application to the City's Historical Commission, asking that <br /> it recommend the issuance of waivers of the certificates of appropriateness for the Moffat <br /> Building and Stovies Stove Shop Building, in order to allow demolition of those buildings <br /> for development and construction of the Regional Center at the Hewitt Avenue Site. <br /> 24. On November 14 and 28, 2001, the Historical Commission conducted public <br /> hearings to consider the application for waivers and made its recommendation to the City <br /> Council against granting such waivers. <br /> 25. On December 12, 2001,the City Council held a public hearing to consider the <br /> recommendation of the Everett Historical Commission with respect to the waivers of the <br /> certificates of appropriateness and the proposed demolition of the Moffat and Stovies Stove <br /> Shop Buildings. The City Council reviewed the record of the Historical Commission, the <br /> Commission's findings, conclusions and recommendation,the minutes and transcripts of the <br /> Commission's public hearing, all letters and documents considered by the Commission, and <br /> approximately seven hours of testimony and other evidence presented at the Council's own <br /> public hearing. By adoption of Resolution No. 5133, the City Council approved the waivers <br /> for the Hewitt Avenue Site. No appeal was made of the Council's decision. <br /> 26. On December 18, 2001, the PFD entered into a Utility Relocation Agreement <br /> with PUD No. 1 of Snohomish County to relocate the 115kV overhead transmission lines, <br /> communication facilities, and associated guys, anchors and materials to enable construction <br /> of the Regional Center at the Hewitt Avenue Site. <br /> S:UIIes\WINWORD\resolution re.initiative.doc <br /> 4 <br />
