ei° <br /> RESOLUTION NO. 5134 <br /> A RESOLUTION re-setting the time and date of the public <br /> hearing for the proposed vacation of the alley located in <br /> Block 652, and a portion of State Street between Block 651 <br /> and Block 652, Plat of Swalwell's 1st Addition and repealing <br /> Resolution No. 5125 <br /> WHEREAS, the owners of more than two-thirds of the front footage abutting the alley, <br /> described as follows: <br /> All that portion of the Plat of Swalwell's 1st Addition to Everett, according <br /> to the plat thereof, recorded in Volume 2 of Plats, Page 103, records of <br /> Snohomish County, Washington; described as follows: <br /> BEGINNING at the Southwest corner of Lot 30, Block 652 of said plat; <br /> THENCE, East along the South line of said Lot 30 to intersect the <br /> Southerly right of way line of the Eastbound On-ramp from Interstate <br /> Highway 5 to U.S. Highway 2; THENCE, Southeasterly along said <br /> Southerly right of way line to intersect the West line of Lot 10, Block 651 of <br /> said plat; THENCE, South along said West line of said lot to the <br /> Southwest corner thereof, and the Northerly right of way line of Hewitt <br /> Avenue; THENCE, Westerly along said Northerly right of way line of said <br /> Hewitt Avenue to the Southeast corner of Lot 1, Block 652 of said plat; <br /> THENCE, North along the East line of said Lot 1 of said block to the <br /> Northeast corner thereof; THENCE, West along the North line of Lots 1 <br /> through 5, inclusive to intersect the Southerly projected West line of Lot <br /> 30; THENCE, North along said Southerly projection to the Southwest <br /> corner of said Lot 30 of said Block 652, and the POINT OF BEGINNING <br /> LESS any portion falling within Interstate 5/ U.S. 2 right of way corridor. <br /> and shown on the attached sketch, have petitioned for the vacation of said right-of-way; <br /> and <br /> WHEREAS, R.C.W. 35.79.010 provides that City Council shall, by resolution, fix a date <br /> for public hearing on said petition; and <br /> WHEREAS, in Resolution No. 5125 City Council did fix December 12, 2001 at 8:30a.m. <br /> as the date and time of the public hearing for said proposed right of way vacation; and <br /> WHEREAS, R.C.W. 35.79.020, in part, requires "...twenty days' notice of the pendency <br /> of the petition by written notice posted in three of the most public places in the city..., <br /> and like notice in a conspicuous place on the street or alley sought to be vacated."; and <br />
