8. The notebook includes a graphic identifying proposed open space areas, both public and <br /> private, on the proposed development site, and existing open space areas in the North <br /> Marina Redevelopment area. Staff has asked the applicant for a comparison of the <br /> proposed plan open space area calculations with the open space areas proposed by the <br /> plan alternatives identified in the existing development agreement. <br /> 9. The 65 foot and 45 foot tall building perspectives represent a concept of what rooftop <br /> building forms may look like in the residential areas. These graphics are intended to <br /> demonstrate the building appurtenances that will exceed the building height, such as <br /> elevator towers, stairwell access, mechanical equipment enclosures, and sloping roof <br /> forms. The maximum proposed height of appurtenances is 10 feet above the permit <br /> building height. These graphics are intended to represent the potential scale and extent of <br /> rooftop appurtenances located above the building height limit, but are not intended to <br /> show the proposed design of building roof forms. Buildings have not yet been designed <br /> to the level of detail to commit to a specific rooftop appurtenance limitation. <br /> 10. The photos showing rooftop garden concepts are taken from existing buildings showing <br /> the quality of the spaces that may be provided on the subject residential buildings. These <br /> areas with landscaping, trellises and deck furniture would be located above the roof and, <br /> in some cases, above the maximum permitted building height. <br /> 11. This diagram is self-explanatory, indicating typical architectural building elements that <br /> are proposed to be allowed to encroach into the 13th Street view corridor, including eaves, <br /> decks, balconies and bay windows that are proposed to be permitted a maximum 5-foot <br /> encroachment; and storefront awnings or marquees that are proposed to be permitted a <br /> maximum 10-foot encroachment. <br /> 12. No comment on the Company 39 methodology. <br /> 13. This diagram is intended to illustrate through a scale drawing how the view protection <br /> diagram in the existing development agreement does not accurately represent the heights <br /> permitted by the site plan identified as Attachment C in the agreement. The Port/ <br /> Maritime Trust propose to eliminate the diagram on page 12 of the existing development <br /> agreement. This diagram is located between conditions 3 and 4 under Section 3.6 of the <br /> agreement, General Conditions. However, there is no specific reference in the agreement <br /> to this diagram, and General Condition #3, which talks about view protection, makes <br /> reference several times to Attachment C. The language in General Condition#3 <br /> describes a view plane concept that is illustrated by the diagram on the top of page 12 of <br /> the development agreement. The diagram is not a scale representation of the topography <br /> of the North Marina site or the bluff, but does convey the premise used to decide how to <br /> modify the 35-foot permitted building height in the underlying W-C zoning of the site. <br /> Attachment C in the development agreement is the site plan showing where permitted ___ <br /> building height has been established by General Condition#3. When the building heights <br /> permitted by this site plan are drawn in cross-section view to scale, as indicated by the <br /> graphic at the bottom of the page in the notebook, there are two areas where the view <br /> 5 <br />
