5 <br /> Ordinance No. <br /> An Ordinance relating to Restrictions on Precursor Drugs, <br /> Amending Section 1 of Ordinance No. 2541-01, as amended by Section 1 of Ordinance <br /> No. 2788-04 (EMC 10.39.010). <br /> Whereas,the state legislature has found that communities all over Washington <br /> have experienced an increase in the illegal manufacture of methamphetamine, which <br /> creates a significant threat to the health and safety of the public; and <br /> Whereas, state and city criminal provisions currently restrict the sale, transfer, <br /> purchase and possession of the drugs ephedrine, pseudoephedrine and <br /> phenylpropanolamine,which are known as "precursor drugs" and are used in the illegal <br /> manufacture of methamphetamine; and <br /> Whereas,in an effort to address the illegal manufacture of methamphetamine the <br /> 2005 state legislature lowered the number of packages of products containing precursor <br /> drugs that can be sold in a single transaction from three packages to two packages; and <br /> Whereas, the state law amendment took effect January 1, 2006; and <br /> Whereas, the Everett City Council deems it appropriate for the City Criminal <br /> Code to be consistent with state law in this area; <br /> NOW,THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: Section 1 of Ordinance No. 2541-01, as amended by Section 1 of Ordinance <br /> No. 2788-04 (EMC 10.39.010), which reads as follows: <br /> Unlawful sale or purchase of ephedrine, pseudoephedrine, or phenylpropanolamine. <br /> A. It is unlawful for a pharmacy licensed by, or shopkeeper or itinerant vendor registered <br /> with the Department of Health under Chapter 18.64 RCW, or an employee thereof, or a <br /> practitioner as defined in RCW 18.64.011 knowingly to sell, transfer, or to otherwise <br /> furnish, in a single transaction: <br /> 1. More than three packages of one or more products that he or she knows to contain <br /> ephedrine,pseudoephedrine, or phenylpropanolamine, their salts, isomers, or salts <br /> of isomers; or <br /> 2. A single package of any product that he or she knows to contain more than three <br /> grams of ephedrine, pseudoephedrine, or phenylpropanolamine,their salts, <br /> isomers, or salts of isomers, or a combination of any of these substances. <br /> B. It is unlawful for a person who is not a manufacturer, wholesaler, pharmacy, <br /> practitioner, shopkeeper, or itinerant vendor licensed by or registered with the <br /> 15 <br />
