The City shall have the authority to require revisions to a <br /> project design which does not meet the Design Guidelines, and to suggest revisions <br /> which will result in a design which meets both the code requirements and design <br /> guidelines. Any appeal of a decision made by City staff in the administration of these <br /> guidelines shall be reviewed by the Hearing Examiner, in accordance with the <br /> Administrative Procedures Ordinance. <br /> BE AND THE SAME IS HEREBY AMENDED TO READ AS FOLLOWS: <br /> C. Review Process. The Planning Department will administratively review projects for <br /> compliance with the requirements of the Zoning Code. The City requires an applicant to <br /> submit plans for a pre-application review prior to formal submittal in order to provide <br /> advice concerning various City requirements. This process will also be used to provide <br /> information and suggestions to the applicant concerning compliance with Zoning Code <br /> standards and these design guidelines. The guidelines contained herein will also be used <br /> to assist the Planning Department staff to determine if the project meets the design related <br /> requirements of the Code. Any appeal of a decision made by City staff in the administration of these <br /> guidelines shall be reviewed by the Hearing Examiner, in accordance with the City's <br /> Local Project Review Procedures Ordinance. <br /> SECTION 2: Nothing in this resolution shall be construed as abating any official action <br /> of the City now pending under or by virtue of the resolution herein amended or <br /> superseded by the adoption of this resolution or as waiving any right of the City under the <br /> policies, provisions and regulations amended or superseded by the adoption of this <br /> resolution. <br /> SECTION 3: If any section, subsection, paragraph, sentence, clause or phrase set forth <br /> in this resolution or its application to any person or situation be declared unconstitutional <br /> or invalid for any reason, such decision shall not affect the validity of the remaining <br /> portions of this resolution or its application to any other person or situation. The City <br /> Council of the City of Everett hereby declares that it would have adopted this resolution <br /> and each section, subsection, sentence, clause, phrase, or portion thereof irrespective of <br /> the fact that any one or more sections, subsections, sentences, clauses, phrases or portions <br /> be declared invalid or unconstitutional. <br /> SECTION 4: It is expressly the purpose of this resolution to provide for and promote <br /> the health safety and welfare of the general public and not to create or otherwise establish <br /> or designate any particular class or group of persons who will or should be especially <br /> protected or benefited by the terms of this resolution. <br /> 2 <br />
