The City shall have the authority to require revisions to a project design which does not meet the Design Guidelines, and to suggest revisions which will result in a design which meets both the code requirements and design guidelines. Any appeal of a decision made by City staff in the administration of these guidelines shall be reviewed by the Hearing Examiner, in accordance with the Administrative Procedures Ordinance. BE AND THE SAME IS HEREBY AMENDED TO READ AS FOLLOWS: C. Review Process. The Planning Department will administratively review projects for compliance with the requirements of the Zoning Code. The City requires an applicant to submit plans for a pre-application review prior to formal submittal in order to provide advice concerning various City requirements. This process will also be used to provide information and suggestions to the applicant concerning compliance with Zoning Code standards and these design guidelines. The guidelines contained herein will also be used to assist the Planning Department staff to determine if the project meets the design related requirements of the Code. SECTION 2: Nothing in this resolution shall be construed as abating any official action of the City now pending under or by virtue of the resolution herein amended or superseded by the adoption of this resolution or as waiving any right of the City under the policies, provisions and regulations amended or superseded by the adoption of this resolution. SECTION 3: If any section, subsection, paragraph, sentence, clause or phrase set forth in this resolution or its application to any person or situation be declared unconstitutional or invalid for any reason, such decision shall not affect the validity of the remaining portions of this resolution or its application to any other person or situation. The City Council of the City of Everett hereby declares that it would have adopted this resolution and each section, subsection, sentence, clause, phrase, or portion thereof irrespective of the fact that any one or more sections, subsections, sentences, clauses, phrases or portions be declared invalid or unconstitutional. SECTION 4: It is expressly the purpose of this resolution to provide for and promote the health safety and welfare of the general public and not to create or otherwise establish or designate any particular class or group of persons who will or should be especially protected or benefited by the terms of this resolution. 2
