l'IP#. 7 1 <br /> Resolution No. 4995 <br /> A Resolution adopting findings, conclusions, and decision in the matter of <br /> Food Services of America's application for a Special Property Use Permit for a <br /> helipad. <br /> WHEREAS, the City Council finds: <br /> 1. Food Services of America(FSA) owns an approximately 32 acre parcel of land that is the site of <br /> a former sand and gravel mining operation that they are developing under the M-1 Zone. This <br /> area is an industrial designated area surrounded on three sides by residential development, <br /> including both multi-family and single family homes; and <br /> 2. It is an unusual area because it is a projection of Southwest Everett industrial property into a <br /> residential area; and <br /> 3. FSA proposes to construct a helicopter landing facility(helipad)to allow them to operate a <br /> business jet helicopter to transport company officers, employees, vendors and customers <br /> between their several Puget Sound facilities; and <br /> 4. Helipads are regulated under the Special Property Use section of the Zoning Code. This is <br /> codified under E.M.C. 19.41.150, hereinafter referred to as "Zoning Code"; and <br /> 5. A SEPA Final Mitigated Determination of Non-Significance on this proposal was issued on <br /> June 15, 2000; and <br /> 6. Although SEPA was used to assess whether there are probable significant adverse effects <br /> requiring detailed study in an Environmental Impact Statement, this proposal is also subject <br /> specific criteria in the Special Property Use General Evaluation Criteria(E.M.C. 41.150C) and <br /> the Evaluation Criteria for the Specific Uses section on Airfields, Helipads, Seaplane Terminals <br /> and Landing Facilities (E.M.C. 41.150D.1.d.). These provisions, among other things, require <br /> Council to evaluate the use for undesirable impacts and specifically requires that helipads be <br /> located to minimize noise impacts; and <br /> 7. E.M.C. 41.150C also requires the Council to evaluate the need of the neighborhood, district or <br /> City for a proposed special property use. This criterion does not distinguish between public and <br /> private proposals and, therefore, is applied to private special uses; and <br />
