2. The proposal is part of the 1999 update to the Comprehensive Plan. The <br /> City issued a mitigated determination of non significance (MDNS) on March 20, <br /> 2000 for the proposal. <br /> 3. Surrounding Land Uses: <br /> a) North: R-2; Single family homes run full length of Berkshire along <br /> the top of Albertson's retaining wall. <br /> b) South: R-1 to the southeast; single family homes. While R-3 lies to <br /> the southwest where a multiple family building is located at the <br /> bottom of the hill. <br /> c) East: R-2; Single family homes — some duplexes. <br /> d) West: B-2; Retaining wall, Albertson's /commercial area and <br /> Evergreen Way. <br /> 4. Site Conditions: <br /> The subject site is occupied by four single family homes, each on its own lot. <br /> The property slopes down to the west from Berkshire. The western property line <br /> is located on top of a 35 foot high retaining wall behind and above an Albertson's <br /> grocery store. The retaining wall was constructed under a non exclusive <br /> easement agreement with Albertson's. Early morning loading dock operations <br /> and HVAC equipment noise from the store has generated complaints from <br /> owners of homes next to the retaining wall. <br /> 5. Mr. Avery has stated that he anticipates the requested rezone would lead <br /> to construction of two 17 unit multi family structures used for senior housing. <br /> 6. The Comprehensive Plan requires that the following factors shall be <br /> considered in reviewing land use map amendment requests. <br /> The City Council must carefully evaluate requests to amend the Land Use <br /> Map to determine the long term benefit to the community as a whole. Whether <br /> initiated by the City or a private party, the burden of proof is upon the proponent <br /> to demonstrate the long term benefit to the community that result from his or her <br /> proposal. The following factors shall be considered in reviewing such <br /> amendment requests. <br /> a) The proposed land use designation must be supported by or be <br /> consistent with the existing policies of the various elements of the <br /> comprehensive Plan. <br /> 2 <br />
