The ordinance established a citizen's review <br /> conunittee composed of community members chosen by the Mayor and allocating the Committee to spend up <br /> to $3,000 from the City Council's contingency fund. Although it does not appear that the Council intended <br /> for the committee to continue from year to year,the ordinance did not include a sunset or expiration clause <br /> and was codified in the Everett Municipal Code at Chapter 2.98 <br /> On November 5, 1996, Everett citizens adopted an amendment to the City Charter. Section 16.5 of the <br /> Charter provides for decennial review and creates a mechanism for selection of the citizen's review <br /> committee. <br /> Ordinance 506-78 conflicts with Section 16.5 of the Charter to the extent it specifies a different mechanism <br /> for selection of the committee. The Ordinance also authorizes expenditure of monies from the Council <br /> Contingency Fund, which is inappropriate. <br /> Because the Charter now provides the mechanism for charter review, which has been implemented by <br /> Council resolution no. 5721 adopted on January 11, 2006, Ordinance 506.-78 should be repealed. <br /> RECOMMENDATION (Exact action requested of Council): <br /> Adopt an Ordinance relating to the Citizen's Charter Review Committee and repealing Ordinance 506-78 <br /> (EMC Chap. 2.98). g <br /> S:PCORNI S H:WORD CouncilAgenda Agenda Coversheet-Proc-2-14-05 <br />
