10 <br /> ORDINANCE NO. <br /> AN ORDINANCE providing for the vacation of that portion of <br /> Rockefeller Avenue between 13th and 14th Streets and the north/south alley <br /> between 13th and 14th Streets within Block 248, Plat of Fourteenth Street Addition <br /> to Everett. <br /> WHEREAS, Providence Everett Medical Center (the "Petitioner") did petition for the <br /> vacation of certain rights-of-way in the City and the City Council of the City of Everett did, by <br /> Resolution No. 5698, duly adopt and fix the 5 day of Decembgr, 2005 at 8:30A.M. as the date <br /> of public hearing and by City Council action on December 5t , the hearing was continued to <br /> December 21st, 2005 at 6:30 P.M. and <br /> WHEREAS,due and legal notice of the time and place of said hearing and determination <br /> of said Resolution has been given by the City Clerk in the manner prescribed by law; and <br /> WHEREAS, at the time and place fixed for hearing, the issues were publicly presented; <br /> and <br /> WHEREAS, the City Council finds it would not vacate said rights of way if it did not <br /> retain easements for utilities in said rights of way to be vacated, as provided for in this ordinance; <br /> and <br /> WHIREAS, it now appears to the City Council of the City of Everett that the said rights <br /> of way resolved to be vacated should be vacated pursuant to the terms and conditions of this <br /> ordinance: <br /> NOW,THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: <br /> That the following described right-of-ways: <br /> That portion of Rockefeller Avenue right of way lying between and adjoining <br /> Block 247, Plat of Everett Division "R" according to the plat thereof recorded in <br /> Volume 6 of Plats, Page 33, and Block 248, Plat of Fourteenth Street Addition to <br /> Everett, according to the plat thereof recorded in Volume 10 of Plats, Page 71, <br /> both of the above plat references are to be found in the records of Snohomish <br /> 5' 5 <br />
