10 ORDINANCE NO. AN ORDINANCE amending the City admission tax Ordinance No. 162-71 and Ordinance No. 2977 (EMC 3.20) to exclude the Everett Events Center as a "place" where activities are subject to the admission tax, to exempt the Everett Public Facilities District from the imposition of the admission tax and the ten percent tax on excess charges over the ticket price on tickets sold elsewhere, and to exempt from the tax, any "person" as defined in the ordinance, who conducts activities such as games, plays, performances, displays or other similar activities, etc. at the Everett Events Center. WHEREAS, the Everett Events Center serves as an important venue for games, plays, performances, displays, or other similar activities; and WHEREAS, activity in and around the Everett Events Center has contributed toward the revitalization of Everett's downtown core and its standing as a tourist destination in the Puget Sound region; and WHEREAS, based on its success in ticket sales in 2005, the Everett Events Center was rated number eight in the world for facilities its size; and WHEREAS, the City of Everett has imposed an admission tax, throughout the City, on activities such as games, plays, performances, displays, or other similar activities, etc. under Ordinance No. 162-7 and Ordinance No. 2977 (Chapter 3.20 EMC), including those activities occurring at the Regional Center which is owned, operated and maintained by the Everett Public Facilities District ("District") under Chapter 35.57 RCW and which is commonly referred to as the "Everett Events Center"; and WHEREAS, the proceeds under the City's admission tax were devoted to the payment of improvements at the Everett Events Center as required for such City admission tax on admission at Regional Centers under RCW 35.57.120; and 67 P. 1of5
