8 <br /> Licensee's equipment or any structural enhancement, except to the extent that any installation, <br /> construction or maintenance work is performed by labor provided by Licensor. <br /> iv. With the permission of Licensor, Licensee has the right to authorize the use of the <br /> aforesaid access by Licensee's contractors, agents, servants, employees and permittees when it is <br /> necessary for them or any of them to have access to the Site or the facilities used to furnish <br /> utility services to the Site, however, distribution of a key to the Site or access by Licensee shall <br /> be made only upon the prior written consent of Licensor. Licensor reserves the right to access <br /> the Site for purposes of inspection and operating, maintaining and servicing its property, <br /> improvements and equipment. Licensee shall provide Licensor with the names of individuals <br /> authorized on behalf of Licensee to access the Site and facilities subject to this License. <br /> Licensee must provide for separately metered utility services at the Site. Alternatively, Licensor <br /> may agree to establish a flate rate fee for utility consumption of all installed Licensee equipment <br /> based upon manufacturer power consumption values and an assumption of a 100% transmitter <br /> duty cycle. Subject to the provisions of this License and to obtaining Licensor's approval(s) as <br /> set forth herein and subject to Licensor's written agreement regarding Site improvements, any <br /> work by Licensee on the Site and Licensee obtaining all required permits, Licensee can: <br /> a. Transmit and receive radio signals on various frequencies; <br /> b. Furnish, install and use in, upon and under and remove from the Site such wires, <br /> equipment and other property of whatsoever kind and nature as Licensee deems <br /> necessary; <br /> c. Connect such wires and equipment to utility lines adjoining the Site; and <br /> d. Install a standby power generator and fuel supply for Licensee's exclusive use at a <br /> location on the Site acceptable to both parties. <br /> e. Special circumstances may require additional construction, installation of unique <br /> additional equipment or the consolidation of facilities, including Licensee antenna <br /> systems, feedlines and power sources, including standby power supplies. <br /> v. All work done by Licensee at the Site, including work on the Tower, shall be <br /> done in a safe and lawful manner, by skilled workers, and in conformity with all applicable laws, <br /> ordinances and regulations. All tower work will use properly trained, certified and equipped <br /> tower crews, approved in writing by Licensor prior to the commencement of any tower work. <br /> All work on the Site will be supervised by a Licensor representative, with on-site time, travel <br /> time and 15% overhead billed to Licensee. Execution of this agreement represents acceptance of <br /> the billing for Site construction work supervision by a Licensor representative. Use by Licensee <br /> of the Site and Tower shall not conflict with Licensor's use of the Site, Tower and related <br /> facilities. Licensee agrees that its use of the Site and Tower shall not conflict with the authorized <br /> use of the Site, Tower and related facilities of other users. Licensee shall permanently label all <br /> antennas, cables and equipment in a manner that provides readily visible ownership <br /> identification. <br /> 51 3 <br />
