8 <br /> vi. Upon review and approval of the Site improvement drawings and design <br /> documents and after receipt of written authorization by the Licensor; Licensee is authorized to <br /> construct on the Site and Tower consistent with that authorization; and Licensee has the right to <br /> prepare, maintain and alter the Site for Licensee's business operations and to install transmission <br /> lines, connecting antennas to the transmitters and receivers. <br /> vii. Licensee agrees that in the event there is any interference with Licensor's <br /> transmitters and/or receivers or in the event there is any interference with the transmitters and/or <br /> receivers of other co-located licensees which were established at the Site prior to the date of this <br /> License, caused by Licensee's transmitter(s) and/or receiver(s), which is not remedied by <br /> Licensee within seventy-two (72) hours of verbal notification by Licensor, Licensee agrees to <br /> cease using the equipment which is creating the interference (except for short tests necessary for <br /> the elimination of the interference) until the interference is eliminated. Provided, however, <br /> notwithstanding any language herein, Licensee agrees that in the event that Licensee's wireless <br /> communications facility, installation or equipment causes any interference with a public safety <br /> communications system(s) whether said system is existing, planned or yet to be constructed that <br /> is not remedied by Licensee within six (6) hours of verbal notification by the public safety <br /> communications system, Licensee agrees to cease using the facility or equipment which is <br /> creating the interference (except for short tests for the elimination of the interference when <br /> authorized by the public safety communications system) until the interference is eliminated to a <br /> standard and manner acceptable to the public safety communications system. <br /> viii. Licensee will contact Licensor at the completion of the work at the Site and will <br /> be present for a full inspection by Licensor. Licensor requires that Licensee retain the services of <br /> NorthWest Tower Engineering or other Licensor approved tower engineering firm to participate <br /> in the final inspection of all Site work. <br /> ix. Within 30 days of the completion of the work, Licensee will prepare and deliver <br /> to Licensor, updated full size `as-built' drawings and AutoCad data files, using the existing <br /> Licensor drawings as a baseline drawing set, which show all changes, modifications and <br /> additions made in all areas of the Site. <br /> 4. RENT: There shall be no rent due for Licensee's use of the Site as described <br /> herein. <br /> Unless Licensor and Licensee agree to a monthly charge for electricity to be paid without <br /> metering, Licensee shall have a separate meter to measure Licensee's electric consumption and <br /> Licensee shall pay directly to the public utility company for any electricity used by Licensee's <br /> equipment. If a flat fee for utility consumption is to be established, fee will be set by separate <br /> agreement. The flat rate utility payment will also include an annual increase of 5% for each year <br /> following the initial License Agreement year. <br /> i. If applicable, in addition to the foregoing payments, Licensee will share the cost <br /> of utilities paid by Licensor such as electrical power, tower lighting, and tower and compound <br /> maintenance. This fee will be determined by the parties and will be paid to Licensee prior to the <br /> beginning of each License annual period. <br /> 4 <br />
