The eaaement is over and across a tract of land situated in the County of • Snohosish, State of Washington, and the easement is descr.ibed as folloas; See Exhibit "A" attached hereto and incorporated herein by reference. This easement is granted subject to and conditioned upon the folloving tetms, conditions and covenants: 1. Grantor shall at all times conduct its activities and all other activities conducted on Grantor's property so as not to interfere with, obstruct or endanger the usefulness of any improvements, or other facilities, nov or hereafter maintained upon the easement, or in any vay interfere vith, obatruct or endanger the City's use of the easement. 2. Prior to any construction, aork or any other activity by Grantor on the easement, a notiftcatlon and plans for the same shall be subm:rted in writing to the City by Contractor and no such construction, aork or activity by Grantor shall be commenced vithout City's prior written agreement that the Grantor's proposed construction, work or activity will not interfere vith the City's easement granted herein; PROVIDED, NOWEVER, any changes or reviaions in the plans ehall also be aub�ect ta City's prior agreement. The City's review of the Grantor's plans under this easement shall not be deemed to impose any ' duty or obligation on the City to determine the adequacy oz sufficiency of Grantor's plans and deaigns nor whether Grantor's construction, vork or activity is in conformance with other applicable plans, codes and regulations.
