3 <br /> WHEREAS,the City Council requested additional changes to the building plans to <br /> address bulk and scale of building facades, and did remove the requirement for <br /> complying with the Historic Overlay Zone design standards; and <br /> WHEREAS, the Zlab's did provide additional information requested by the City Council <br /> concerning building design, dimensional standards,building materials and maintenance; <br /> and <br /> WHEREAS, the City Council finds that the proposed changes to the building elevations, <br /> though different in style,provide a quality comparable to that originally approved by the <br /> City Council in the original development agreement; and <br /> WHEREAS,the City Council did consider the proposed changes to the original <br /> development agreement between Joe and Shawna Zlab and the City; and <br /> WHEREAS,the City Council concludes: <br /> 1. The rezone is consistent with the Everett Comprehensive Plan; <br /> 2. The rezone bears a substantial relation to the public health, safety and welfare; <br /> 3. The rezone promotes the best long-term interests of the Everett Community; <br /> and <br /> 4. The rezone mitigates adverse impacts upon existing or anticipated land uses in <br /> the immediate vicinity through the development agreement. <br /> NOW, THEREFORE, BE IT RESOLVED that the City Council hereby authorizes the <br /> Mayor to execute an amendment to the Zlab Rezone Development Agreement approving <br /> revisions to the building plans and elevations. <br /> COUNCILMEMBER INTRODUCING RESOLUTION <br /> Passed and Approved this day of , 2006 <br /> CITY COUNCIL PRESIDENT <br /> 9 <br />
