City of Everett f3 <br /> Resolution No. <br /> A Resolution Authorizing the Mayor to Execute Amendments to the Joe Zlab <br /> Rezone Development Agreement Approving Revisions to the Building Elevations. <br /> WHEREAS, the City Council approved Rezone Ordinance No. 2847-05 in July, 2005, as <br /> part of the annual docketing process for property located on the east side of the 2600 <br /> block of Rockefeller Avenue, for Joe and Shawna Zlab, rezoning said property from R-4 <br /> to R-5; and <br /> WHEREAS, the City Council required a Development Agreement between the Zlab's <br /> and the City in order to ensure that the character and quality of the development concept <br /> presented to the public, Planning Commission and City Council would be constructed; <br /> and <br /> WHEREAS, the Development Agreement requires major modifications to the building <br /> design to be reviewed by the Planning Commission and approved by the City Council; <br /> and <br /> WHEREAS, the Zlab's have proposed revisions to the building elevations that change the <br /> appearance of exterior details and implied materials; and <br /> WHEREAS, the Zlab's have presented the proposed changes and reasons for said <br /> changes to the Planning Commission; and <br /> WHEREAS, the Planning Commission took public testimony following notification of <br /> property owners in the surrounding area and the Bayside Neighborhood Association; and <br /> WHEREAS, the Planning Commission found that the proposed changes to the building <br /> elevations do not substantially alter the character of the building and still represent the <br /> level of quality previously represented by the Zlab's; and recommended that the City <br /> Council approve the proposed changes; and <br /> WHEREAS, the City Council conducted public hearings on February 22, 2006; March 1, <br /> 2006; and March 15, 2006 to consider the recommendation of the Planning Commission <br /> to approve the proposed changes to the building elevations; and <br /> 8 <br />
