5 <br /> advance of the start of the Tournament and shall make such reasonable changes and shall <br /> seasonably supplement the plan if requested by the City. NSA shall stop play on a <br /> particular field if continued safe play is not reasonably likely for any reason, such as <br /> unruly crowds or unsafe weather or field conditions. NSA shall have sole responsibility <br /> for determining whether games may be played safely. <br /> D. PROPERTY <br /> NSA shall be responsible for any and all damage to City-owned property from NSA's <br /> Tournament. NSA shall leave and/or return properties in the same or better condition at <br /> the conclusion of the Tournament. Photographic documentation and field determinations <br /> shall be used to establish before and after conditions. <br /> 7. ADMISSION <br /> NSA shall set admission prices, shall provide gatekeepers for admission ticket sales and <br /> collection, and charge, collect and retain all gate admissions at Tournament sites. <br /> 8. CONCESSIONS <br /> A. MERCHANDISE AND SOUVENIRS <br /> NSA may sell merchandise and souvenirs and retain all proceeds from souvenir sales. <br /> The City shall not provide space, facilities, or personnel for the sale of merchandise and <br /> souvenirs. NSA shall approve all merchandise vendors, and provide list of approved <br /> vendors to City in advance of the Tournament. The City reserves the right to eject <br /> merchandise vendors who, in the reasonable opinion of the City, are inappropriate for a <br /> girls fastpitch Tournament, who violate City, state or federal laws or regulations, or who <br /> engage in misconduct during the Tournament (e.g., engaging in shouting matches with <br /> other vendors). <br /> B. REFRESHMENTS <br /> Only the City or the City's contractor(s)may sell food and drink. Proceeds from such <br /> sales shall be retained by the City, or distributed pursuant to the City's agreement with <br /> any contractor(s). Concession stands will be open daily one hour prior to first game and <br /> stay open through the end of the final game each day. <br /> 9. TOURNAMENT ADMINISTRATION <br /> A. NSA shall provide a Tournament Director and Director of or Chief Umpire, as <br /> well as an assistant director and assistant chief at each Tournament site. Such people <br /> shall have the requisite training, skill and experience necessary to manage the <br /> Tournament and sites. <br /> B. The Tourism Bureau and City may provide local tourism and promotion materials <br /> to NSA to include in the Tournament coaches packets and/or website links. NSA shall <br /> 12 <br />
