Mary Berlin, 929 Peck' s Drive <br /> Lot 20, Block 7 , Beverly Hills Division No. 4 , <br /> except the west 70 feet -- 20 feet to 18 feet. <br /> Zoning: R-2, Single-Family High-Density Residence Zone <br /> AND: WHEREAS, (date) October 6, 1975 was fi::ed as the date <br /> of hearing on said application and proper notice having been <br /> given as required by law, <br /> AND: WHEREAS, a public hearing was held on said date and the <br /> Board of Adjustment, after reviewing all testimony, made the find- <br /> ings that: <br /> 1. There are exceptional circumstances applying to the <br /> subject property that do not apply to other proper- <br /> ties in the same vicinity; specifically, because <br /> in order for the City to carry out the Peck' s Drive <br /> Improvement Project certain front yard setbacks had <br /> to be less than the required twenty (20 feet) <br /> due to the acquisition of property by the City. <br /> 2 . Granting the variance will not be detrimental to the <br /> public welfare or injurious to other properties in <br /> the vicinity. <br /> 3. The variance is necessary for the preservation and <br /> enjoyment of a substantial property right; because <br /> a hardship was created to the Peck' s Drive residence <br /> when it became necessary to acauire property in <br /> order to carry out the street improvement oroject. <br /> 4 .
