Granting the variance will not. be detrimental to the <br /> ( public welfare or injurious to other properties in <br /> the vicinity. <br /> � 3. The variance is necessary for the �>*aservation and <br /> enjoyment of a substantial property right; because <br /> a hardship was created to the Peck's Drive residence <br /> when it became necessary to acquire property in <br /> order to carry out the street improveaent project. <br /> 4. The granting of the variance will not adversely affect <br /> I the Comprehensive Land Use Plan. <br /> A hearing was held on the application of Mr. ax�d Mrs. Ewing, <br /> 4718 Forest Drive, Everett for a variance from Chapter 19.14 <br /> Section . 050 Everett Municipal Code, Yard requirements Paragra.ph <br /> C for: � <br /> Permission to build an addition to the existirnJ residence and to <br /> building within six (6) feet of the rear property line rather than <br /> the minimum of twenty (20) feet as required in an R-1, Single- <br /> Faatily Residence Zone. <br /> Legal Description: Lot Sixty-one (61) of Forest Park Addition <br /> to Everett Division 'A' <br /> Address: 4718 Forest Drive <br /> After visually viewing the subject property and considering all the <br /> facts, it was noved and unanimously approved by Chairman Graff and <br /> the Board to grant the applicant's request for the following reasons: <br /> 1. There are exceptional circumstai,ces applying to the <br /> subject property that do not apply to other proper- <br /> - ties in the same vicinity; specifically, if the sixty- <br /> five (65) foot frontage on 48th Street had been con- <br /> sidered, the front yard of the proposed addition would <br /> be in compliance with the or3inance. <br /> 2. If the variance is not granted a hardship cvill exist <br /> to the applicants because medical circur.�stances in <br /> the family necessitate the addition of space for spe- � <br /> cialized treatment equipment. <br /> 3. That the variance is necessary for the preservation <br /> and enjoyment of a substantial property right of the <br /> appellant possessed by owners of other properties in <br /> -2- <br />
