f. Landscaping would be required per Section 35 of the <br />Everett Zoning Code. A landscape plan must be <br />submitted and approved prior to issuance of building <br />permits (see Use Permit y5-90, condition N4). <br />g. The proposed use is an office, which is not commonly <br />associated with nuisance irritants, such as noise, <br />smoke, etc. Other permitted uses within the C-2 zone <br />generate far greater nuisance irritants. <br />h. The proposed use would contribute toward diversity in <br />land uses and would be of slightly greater intensity <br />than the existing single-family residence; therefore, <br />the conversion would be consistent with the goals and <br />policies of the Everett General Plan, which does not <br />encourage lower intensity uses (i.e., single-family <br />dwellings) in commercial land use districts. <br />i. The proposed use, as permitted by building code <br />provisions, Use Permit N5-90, and this decision would <br />satisfy the requirements of the Everett Zoning Code and <br />other applicable ordinances and regulations. <br />DECISION: <br />The Planning Director has made a determination to allow the <br />proposed conversion of a single-family residence to an office at <br />3223 Pine Street. The proposal is consistent with the above <br />evaluation criteria and with the purpose and intent of the C-2 <br />zoning district. <br />Right to Appeal: The applicant or an owner of property located <br />within 300 feet of the subject property may appeal the Planning <br />Director's determination as to whether the proposed use should be <br />a permitted use within the applicable zone district. Any such <br />appeal must be filed within ten (10) calendar days of the date <br />specified below. Appeal forms are available from the Planning <br />Department and must be submitted along with the required filing <br />fee.
