EAL PROPERTY
April 4, 2002
Mr. Tom Edwards
Everett, WA 98203
17fi-b It7Z-A5;
SUBJECT: Request for Alley Vacation Petition
Dear Mr. Edwards:
Enclosed is the required paperwork to initiate a right of way vacation of the alley
abutting your property. The petition and $350.00 application fee should be
accompanied by a map indicating who signed.
State statutes require the signatures of owners of two-thirds of the frontage abutting the
right of way to proceed with the vacation process. However, in a situation such as
yours, 100 percent of the abutting owners must sign the petition in order for you to
receive a favorable staff recommendation. The alley is an amenity to the properties,
and as such has contributory value. Constitutionally, the City cannot "take" property
(value) without compensation. To make a long story short, it would not be in the City's
interest to consider this vacation unless all property owners are in favor of the vacation.
Also, before you spend a lot of time circulating the petition you should be aware that a
property owner on Melvin Ave. has contacted this office indicating "adamant"
opposition to an alley vacation.
If you have any questions regarding this matter please call me at 425-257-8800.
Sincerely,
Lon Mayberry
REAL PROPERTY
c: add file
encl
CITY OF EVERETT • 3200 Cedar Street • Everett, WA 98201 • (425) 257-8800 • Fax (425) 257-8856
