EVERETT CITY COUNCIL <br />FORMAL POLICY <br />STREET AND ALLEY VACATIONS <br />SDecific Criteria for a Vacation Grant: <br />1. That no present need exists for the street or alley. <br />2. That no foreseeable future need exists and the street or alley is clearly surplus property. <br />e3. That there would be no adverse or damaging effect to abutting or neighboring properties, nor <br />discomforts caused to the inhabitants, or occupants thereof. <br />4. That benefit that would be derived by the neighborhood and/or City from the vacation. <br />Specific Criteria for a Partial Vacation Grant: <br />I. It is to be in the best interest of the City, not to be serving the interests of a limited number of <br />property owners. <br />2. Remaining right-of-way will not be rendered difficult to service or maintain as a result. <br />3. It will not result in an irregular right-of-way alignment with abutting and adjacent parcels. <br />Outline of Street Vacation Procedure: <br />I. $350.00 fee and petition received. <br />II. Council acceptance of petition and set hearing date by resolution. <br />III. Notify adjacent owners, occupants and public utilities of proposed vacation, and <br />Public Hearing date. <br />IV. Public Hearing. <br />V. Appraisal ordered after receipt of S400.00 for appraisal where adjoining property is <br />single family residential or $1,000.00 for appraisal for other property uses. <br />VI. Staff review of appraisal, first and second reading of ordinance. <br />VII. 'Third reading of ordinance. Begins 90 day allowance for payment <br />VIII. _Receive payment of 100% of the appraised value of the vacated right-of-way <br />(50% of the ,:praised value of the vacated right- of -way if the right of way has <br />not been pan of a dedicated public right of way for 25 years, or more, in accordance <br />with RCW 35.79.030). <br />98 days absolute minimum <br />105 days about average time <br />NOTES: <br />1. By operation of law, in most, but not all cases, vacated streets and alleys attach to the abutting <br />orooerty, one-half to each; without regard to who applies and/or compensates the City for the vacation. <br />3. Application and appraisal fees are not refundable. <br />4. The vacated right of way is appraised for its contributory value to the parent property, not as an <br />independent strip of land. <br />
