Revised Condition #3 from Becky Fauver, Planning Department <br />All of the exhibits are available for inspection at the Hearing Examiner's Office located at <br />2930 Wetmore Avenue, 8th floor, Everett, Washington. <br />After due consideration of the testimony and evidence presented by the Applicant, <br />testimony and evidence elicited during the public hearing, and as the result of the <br />personal inspection of the subject property and surrounding areas by the Everett <br />Hearing Examiner, the following Findings of Fact and Conclusions constitute the basis <br />of the decision of the Everett Hearing Examiner. <br />FINDINGS OF FACT <br />The Applicant requested approval of construction of a 420 square foot, 19.75 feet <br />high detached garage on property located at 2611 Rainier Avenue, Everett, <br />Washington. EMC 19.7.020.H limits the height of detached accessory structures <br />to a maximum of 15 feet. The Applicant seeks relief from this standard pursuant <br />to the provisions of EMC 19.7.020.K. (exhibit 1, Fauver testimony) <br />2. The subject property is zoned R-4, Multiple-Family High Density. The proposed <br />garage is projected to be located near the eastem property line adjacent to an <br />alley. (exhibit 1, Fauvertestimony) <br />3. EMC 19.7.020.K allows the Hearing Examiner to provide relief from the height <br />restrictions of detached accessory structures. In making such relief, the impacts <br />to be considered include: view obstructions; aesthetic impact on surrounding <br />properties and streetscape; the incompatible scale with the dwellings on • <br />surrounding properties; and, the impact on surrounding neighborhood character. <br />(exhibit 1, EN1C & Fauvertestimony) <br />4. The proposed detached garage would not obstruct any water, territorial, or <br />mountain view. The topography of the site is flat, and the proposed detached <br />garage would be 19.75 feet above this topography. (exhibit 1, Fauver testimony) <br />5. The subject property is developed with a single-family residence. The <br />surrounding properties include multiple-family structures, as �vell as single-family <br />residences. The proposed structure would be located off an alley which is in the <br />rear of the existing residence. (exhibit 1) <br />6. Other detached structures on adjacent properties are present. These structures <br />take access off alleys. The proposed structure would not be significantly different <br />than these structures. (exhibit 1) <br />� <br />
