The proposed detached garage would not be seen from Rainier Avenue. It is <br />designed to be located behind the existing residence on the subject property. It <br />would be constructed with similar materials to the existing residence and would <br />be aesthetically compatible with the residence, as well as the surrounding <br />properties. (exhibit 1, Fauver testimony) <br />8. In an R-4 zoning area, structures, other than accessory buildings, can be built to <br />a maximum height of 80 feet. The proposed structure would be approximately <br />25% of the allowed maximum height for such structures. The proposal is <br />consistent with the scale for surrounding properties. There would be no <br />significant impact to the neighborhood character. (exhibit 1, Fauver testimony) <br />9. There was no opposition testimony submitted. <br />Jurisdfctlon: The Hearing Examiner of t.he City of Evemtt has jurisdictional authority to <br />hold a hearing and to issue the dvcision. That authority is set forth in EMC 2.23.120. <br />Based on the above Findings of Fact, the Hearing Examiner enters the following <br />Conclusions: <br />CONCLUSIONS <br />The Applicant requested approval of construction of a 420 square foot, 19.75 feet <br />high detached garage on property located at 2611 Rainier Avenue, Everett, <br />Washington. EMC 19.7.020.H limits the height of detached accessory structures <br />to a maximum of 15 feet. The Applicant seeks relief from this standard pursuant <br />to the provisions of EMC 19.7.020.K. (finding 1) <br />2. The review elements of EMC 19.7.020.K have been considered. The proposed <br />stn�cture is consistent with all of these elements. (findings 2-8) <br />DECISION <br />Based upon the preceding Findings of Fact and Conclusions, testimony and evidence <br />submitted at the public hearing, and upon the impression of the Hearing Examiner at a <br />site view, it is hereby ordered that the requested 420 square foot detached garage to be <br />constructed at 2611 Rainier Avenue, Everett, Washington, can be constructed to a <br />height of 19.75 feet above the base elevation. This exception is allowed subject to the <br />following conditions: <br />A covenant acceptable to the City Attomey's office shall be recorded on the <br />title to the property stating that the property owner acknowledges the <br />requirements of this section, and stating that the use of any accessory <br />structure is limited to accessory activities permitted by the zone in which the <br />properry is located, and that the accessory building shall not be converted to <br />
