Pursuant to H.U.D. requirements, no member, officer, or employee of the City of Everett, or its <br /> designees or agents, no member of the governing body of the City of Everett, and no other <br /> public official of Everett shall during his tenure or for one year thereafter, have any interest, <br /> direct or indirect, in any contract or subcontract, or the proceeds thereof, for work to be <br /> performed for the Community Housing Improvement Program. Further, no public official of any <br /> other localicy which exercises any function oc responsibility with respect to the Community <br /> Housing Irr.provement Program :,iall during his tenure or for one year thereafter, have any <br /> interest, direct or indirect, in any contract or subcontract, or the proceeds thereof, for work co <br /> be perfonned for the Community Housing [mprovement Program. <br /> i8. Contractors may be deleted temporarily or permanently from the Contractors List. A <br /> contractor may be deleted from the List for oiu or more of the following reasons: <br /> A. Continuous poor quality work, as determined by the Home Impcovement Inspector.� <br /> B. Failure to maintain insurance. <br /> C. Failure to pay subcontractors. <br /> D. Failure to respond to six consecutive requests for bids. In such instances the contractor <br /> shall be deleted from the List temporarily and shall 6e reinstated on the List by <br /> submission of an updated classification to CHIP with Loan Revfew Committee approvai. <br /> E. Failure to respond to complaints by loan recipients. <br /> F. Contractor's insolvency, bankruptcy, or other conduct or condition which has resulted in a <br /> monetary loss to a homeowner ar to the City in connection with the contract work. <br /> G. Abandonment oi a job or repeated failure to complete contract work within the specifie� <br /> time limit. ' <br /> H. Contractor's conviction of a crime in connection with contract work or in connection with <br /> payment or receipt of funds administered by CHIP. <br /> I. Failure to maintain current license and registration with the State ot Washington. <br /> Satisfactory Completion of First Contract. Any contractor must satisfactorily complete one <br /> CHIP loan rehabilitation contract before being permitted to bid those projects which are, in the <br /> Home Improvement Inspector's estimation, $10,000 or more. <br /> Aupeal Procedure <br /> The Loan Review Committee has jurisdiction to hear all appeals. The contractor has ten (l01 <br /> working days in which to appeal the action by CHIP. Said appeal must be in writing and either <br /> hand delivered or received by certified mail by the CHIP office, 3002 Wetmore, Everett, <br /> Washington, 48201 within ten (!0) working days f�om the date of mailing the notification to tne <br /> contractor of nis/her removal from the Contractors List. <br /> The Loan Review Committee shall set a date for the hearing ot appeal. The contractor shall be <br /> notified by certified mail ot said hearing date. At tht hearing, CHIP shall be required to show <br /> reasons why it deems it necessary to take the a�ntractor off of the Contractors List or not <br /> aUow him/her an opaortunity to participate. The ��ontractor may then present reasons why such <br /> action should not be taken. Either side shall have the right to call and examine witnesses on any <br /> matter relevant. A:ter hearing both sides and obtaining any additional intormation it deems <br /> necessary, the Loan Review Committee shall issue a decision. The Loan Review Commi[tce <br /> may adopt or �eject the p�oposed action of CHIP. <br />
