( � <br /> FINDINGS OF FACT <br /> 1. HSBC Bank USA NA Trustee, Respondent, is the owner of record of property at <br /> 2011 Oakes Avenue, Everett, Washington (property). The property is in an R-1 <br /> Single Family Detached Low Density zone. (Exhibit#7, Snohomish County <br /> Assessors Record dated September 14, 2011) (Exhibit#8, Go Sync Map) <br /> 2. On June 16, 2011, the City of Everett Violations Hearing Examiner issued a Finai <br /> Order in this matter. The Order directed the Respondent to abate all vioiations of <br /> the Everett Municipal Code by June 23, 2011, including securing the property by <br /> June 23, 2011. (Exhibit#6, City of Everett Vio/ations Hearing Examiner Final Order <br /> Case#10-1184) (Testimony of Code Enforcement O�cer Fagerstrom) <br /> 3. On July 6, 2011, the Code Enforcement Unit received a complaint that the property <br /> had not been secured and posed a threat to the public safety and that there was <br /> garbage accumulating on the property. (Testimony of Code Enforicement O�cer <br /> Fagerstrom) <br /> 4. On or about August 17, 2011, City of Everett Code Enforcer•��n. �:?t�,,.�r Fagerstrom <br /> conducted a site inspection and was unable to take any ph�xc,y:aphs He observed <br /> that there had been no change in the condition of the property. (7e�fimony of Code <br /> Enforcement O�cer Fagerstrom) <br /> 5. On August 19, 2011, a violation citation was issued to the Respondent for a <br /> violation of International Property Maintenance Code 2009 304.1; 3a8.1; 108.1.3; <br /> 108.2 and 108.6. Copies of the citation were mailed to the Respondent via first <br /> class and registered US mail and a copy was posted at the property, (Exhibit#4, <br /> Violation Citation dated August 19, 2011 with mai!receipts) (Exhibit 1i5, Declaration <br /> of Service dated August 22, 2011 with photo) (Testimony of Code Enforcement <br /> Officer Fagerstrom) <br /> 6. On August 19, 2011, Code Officer Fagerstrom received a phone call from Christine <br /> at the Everett office of Re-Max Real Estate. She stated that she represented the <br /> Bank of America who she believed to be the new owner of the property. She asked <br /> that Code Officer Fagerstrom fax copies of the citation to her. (Testimony of Code <br /> Enforcement Oflicer Fagerstrom) <br /> 7. On September 1, 2011, Code Officer Fagerstmm conducted a follow-up inspection <br /> at the property and observed and photographed that there had been no change in <br /> the conditions on the property.
