� ( � Based on the above Findings of Fact, the Violations Hearing Examiner enters the foliowing Conclusions: CONCLUSIONS OF LAW Jurisdicdon: The Violations Hearing Examiner of the City of Everett has jurisdictional authority to hold a hearing and to issue the decision, EMC §1.20.020. Aoplicable Law: 1. International Property Maintenance Code 304.1 which reads;The exterior of a structure shall be maintained in good repair, structuraily sound and sanitary so as not to pose a threat to the public health, safety or welfare. 2. lnternational Property Maintenance Code 308.1 which reads; All exterior property and premises, and the interior of every structure, shall be free from any accumulation of rubbish or garbage. 3. EMC §1.20.010(E): "Repeat violator" means any person, firm, corporation, association, or agent thereof who has had any order issued pursuant to the provisions in this chapter, including any order issued subsequent to a hearing, any stipulated order and any default order, and within twenty-four months of the issuance of such order commits or allows to be committed a new and separate violation of a same or similar chapter of the Everett Municipal Code that is enforceable under this chapter, regardless of location. Conclusions of Law Based on Above Findinsts: 1. By failing to secure the damaged structure from entry and by allowing the property to become accumulated with trash and garbage, the Respondent has violeted International Property Maintenance Code 2009 304.1; 306.1. ORDER Based on the Findings of Fact and Conclusions of Law as stated above, the following Order is issued: 1. The Respondent shall properly maintain the secure structures from unlawful entry in compliance with the international Property Maintenance Code, Appendix A. This shall remain until structures are inhabited (residence) or removed (residence and garage) or as stated in paragraph 2. The Respondent shall monitor the property and assure that it remains secure, until such time as the property is brought into compliance with the Everett Municipal Code. 2. The Respondent shall appty for and obtain all of the necessary and required permits to bring the property into compliance with the Everett Municipal Code. This must be completed and inspected and approved by the City of Everett Building Division by September 22, 2012. / ! 3�`/ ) __%
