� ( � <br /> Based on the above Findings of Fact, the Violations Hearing Examiner enters the <br /> foliowing Conclusions: <br /> CONCLUSIONS OF LAW <br /> Jurisdicdon: <br /> The Violations Hearing Examiner of the City of Everett has jurisdictional authority to <br /> hold a hearing and to issue the decision, EMC §1.20.020. <br /> Aoplicable Law: <br /> 1. International Property Maintenance Code 304.1 which reads;The exterior of a <br /> structure shall be maintained in good repair, structuraily sound and sanitary so as <br /> not to pose a threat to the public health, safety or welfare. <br /> 2. lnternational Property Maintenance Code 308.1 which reads; All exterior property <br /> and premises, and the interior of every structure, shall be free from any <br /> accumulation of rubbish or garbage. <br /> 3. EMC §1.20.010(E): "Repeat violator" means any person, firm, corporation, <br /> association, or agent thereof who has had any order issued pursuant to the <br /> provisions in this chapter, including any order issued subsequent to a hearing, any <br /> stipulated order and any default order, and within twenty-four months of the <br /> issuance of such order commits or allows to be committed a new and separate <br /> violation of a same or similar chapter of the Everett Municipal Code that is <br /> enforceable under this chapter, regardless of location. <br /> Conclusions of Law Based on Above Findinsts: <br /> 1. By failing to secure the damaged structure from entry and by allowing the property <br /> to become accumulated with trash and garbage, the Respondent has violeted <br /> International Property Maintenance Code 2009 304.1; 306.1. <br /> ORDER <br /> Based on the Findings of Fact and Conclusions of Law as stated above, the following <br /> Order is issued: <br /> 1. The Respondent shall properly maintain the secure structures from unlawful entry in <br /> compliance with the international Property Maintenance Code, Appendix A. This <br /> shall remain until structures are inhabited (residence) or removed (residence and <br /> garage) or as stated in paragraph 2. The Respondent shall monitor the property <br /> and assure that it remains secure, until such time as the property is brought into <br /> compliance with the Everett Municipal Code. <br /> 2. The Respondent shall appty for and obtain all of the necessary and required permits <br /> to bring the property into compliance with the Everett Municipal Code.
