� l � <br /> Exhibit 9 Snohomish County Assessor's Record dated June 1, 2011 <br /> Exhibit 10 Go Sync Map <br /> Exhibit 11 Exhibit List dated June 16, 2011 <br /> Based upon a review of the above record, the following Findings of Fact and <br /> Conclusions hereby constitute the basis of the decision of the Everett Violations Hearing <br /> Examiner. <br /> FINDINGS OF FACT <br /> 1. HSBC Bank USA NA Trustee, Respondent, is the owner of record of the property at <br /> 2011 Oakes Avenue, Everett, Washington (property). The property is in an R-2 <br /> Single-Family Detached Medium Density zone. (Exhibit#9, Snohomish County <br /> Assessor's Prope�ty Information) <br /> 2. On December 10, 2010, a complaint was received by the City of Everett Building <br /> Division regarding the condition of the structure at the property. During the <br /> inspection, numerous violations of the Ciry's electrical and mechanical codes were <br /> noted. A Written Notice was placed on site to describe danger of equipment <br /> including fuse box. An e-maii was sent by the City of Everett Building Division to the <br /> City o,' Everett Code Enforcement Unit requesting an investigation. (Exhi6it#8, Email <br /> irom Ted Budden, City of Everett Burlding Division dated Decamber 10, 2010) <br /> 3. On December 17, 2011 City of Everett Code Enforcement Officer Fagerstrom <br /> conducted an inspection of the property. He spoke to a female occuoant in the rear <br /> building who told him that she was staying in her rear unit temporarily until the ienant <br /> in the front unit was evicted. Code Enforcement Officer Fagerstrom observed that <br /> the Building Divisic,ns written notice had been removed and that there was a large <br /> quanlity of garbage dumped in the garage area of the rear unit. He took <br /> photographs of the condition. (Exhibit#1x-1cc, Inspection Photos dated Decem6er <br /> 17, 2010) <br /> 4. On February 2, 2011, a violation citation was issued to the former owner Jesse <br /> Cates for a violation of International Properiy Maintenance Code 2009 108.1.3&5; <br /> 505.3; 604.1. A copy was mailed to the former owner, Jesse Cates, via first clasa <br /> and registered US mail and a copy was posted at the property. <br /> 5. On February 10, 2011 both the Registered and US Mail copies of the violation <br /> citation were returned to the City of Everett Code Enforcement Unit unclaimed. <br /> 6. On February 17, 2011 Code Enforcement O�cer Fagerstrom became aware that the <br /> property had been foreclosed and that the Respondent was the legal owner. <br /> 7. On March 25, 2011, the rear unit had a structure fire that nearly destroyed the <br /> building. On March 29, 2011, Code Enforcement Officer Fagerstrom conducted a <br /> follow-up inspectioR and photographed the damage and condition of the buiiding at <br /> the property.
