. � � 8. On April 5, 201� Code Enforcement Officer Fagerstrom mailed a written notice to comply to the Respondent, directing that the burned structure had to be properiy secured from entry. (Exhibit#5, Notice to Comply dafed Apri15, 2011) 9. Or.April 14, 2011 City of Everett Police Officer Katzer was sent to the address on a noise disturbance call. Officer Katzer interviewed a female living inside of the residence who told him that the house was without power and that she was running a generator to provide electricity. A moort was wrilten regarding his observations and a copy was sent to the Codo Enforcement Unit. (Exhibit#7, EPD►eport#DD11- 7324 dated April 13, 2011) 10.On April 19, 2011, Code Enforcement Officer Fagerstrom conducted a follow-up inspection of the property. He observed that the rear structure remained open to entry and that the water and power service to the property had been term(nated. Since that time there has been no water service to the property. A condemnation notice was posted on both structures. (Exhibit#1a-1d, Photos dated Apri119, 2011) 11.On April 20, 2011 a violation citation was issued to the Respondent for a violation of Internationai Property Maintenance Code 2009 108.3 & 5; 505.3; 604.1. Copies of the citation were mailed to the Respondent via first ciass and registered US mai� and a copy was posted at the property.(Exhibit�13, Violation Citefion datedApri120, 2011 with mail receipts and Exhibit#4, Declaration of Service dated April 20, 2011 with photo) Based on the above Findings of Fact, the Violations Hearing Examiner enters the following Conclusians: CONCLUSIONS OF LAW Jurisdiction: The Violations Hearing Examiner of the City of Everett has jurisdictional authority to hold a hearing and to issue the decision, EMC §1.20.020.
