On April 5, 201� Code Enforcement Officer Fagerstrom mailed a written notice to <br /> comply to the Respondent, directing that the burned structure had to be properiy <br /> secured from entry. (Exhibit#5, Notice to Comply dafed Apri15, 2011) <br /> 9. Or.April 14, 2011 City of Everett Police Officer Katzer was sent to the address on a <br /> noise disturbance call. Officer Katzer interviewed a female living inside of the <br /> residence who told him that the house was without power and that she was running <br /> a generator to provide electricity. A moort was wrilten regarding his observations <br /> and a copy was sent to the Codo Enforcement Unit. (Exhibit#7, EPD►eport#DD11- <br /> 7324 dated April 13, 2011) <br /> 10.On April 19, 2011, Code Enforcement Officer Fagerstrom conducted a follow-up <br /> inspection of the property. He observed that the rear structure remained open to <br /> entry and that the water and power service to the property had been term(nated. <br /> Since that time there has been no water service to the property. A condemnation <br /> notice was posted on both structures. (Exhibit#1a-1d, Photos dated Apri119, 2011) <br /> 11.On April 20, 2011 a violation citation was issued to the Respondent for a violation of <br /> Internationai Property Maintenance Code 2009 108.3 & 5; 505.3; 604.1. Copies of <br /> the citation were mailed to the Respondent via first ciass and registered US mai� and <br /> a copy was posted at the property.(Exhibit�13, Violation Citefion datedApri120, 2011 <br /> with mail receipts and Exhibit#4, Declaration of Service dated April 20, 2011 with <br /> photo) <br /> Based on the above Findings of Fact, the Violations Hearing Examiner enters the <br /> following Conclusians: <br /> CONCLUSIONS OF LAW <br /> Jurisdiction: <br /> The Violations Hearing Examiner of the City of Everett has jurisdictional authority to <br /> hold a hearing and to issue the decision, EMC §1.20.020. <br /> A�plicable Law: <br /> Intemational Property Maintenance Code 108.1.5, which reads; <br /> Dangerous St�ucture or Premises <br /> For the purpase of this code, any structure or premises that has any or all of the <br /> condidons o�defects described be%w shall be considered dangerous: <br /> 7. The build/ng or structure is neglected, damaged, dilapidated, unsecured or <br /> abandoned so as to become an attracdve nuisance t»chfldren who might <br /> p/ay in the buil�ing or strudure to their damage, becomes a harbor for <br /> vag�ants, cnminals or immoral persons, o.�enab/es person to resort to the <br /> building or strudure for committing a nWsance or an unlawful act. <br /> 3�� � <br /> � <br />
