�� <br />PLANNING DIRECTOR DECISION <br />REVIEW PROCESS I #02-020 <br />June 5, 2002 <br />The Cily of Everett Planning Director grants approval of a request by Beverly Bedient at <br />5521 Ocean Avenue to build an atlached dwelling unit with the following conditions: <br />The applicant must comply with all 13 conditions of Section 39.020.D of the City's <br />Zoning Code (as summarized below), as well as all other provisions of the City's <br />Zoning Code and all othcr applicable Ciry codes. <br />Accessory dwelling units are pertnitted subject to approval by the Planning Director using Review <br />Process I. The Planning Director, using Review Process I, is authorized to "...approve, disapprove, <br />or approve with conditions the use proposed by the applicant." (Subsection 41.100.B) If no appeal <br />is filed in response to the Planning Director's determination, the decision will be considered final. <br />If an appeal of the decision is filed, such an appeal must be submit�ed ro the City's Hearing <br />Gxamincr. <br />Subsection 39.020.D of the Zoning Code establishes 13 criteria by which such proposals must be <br />evaluated. These are as follows: <br />An accessory dwelling unit may be established in an existing single family dwelling unit, on <br />lots containing at Ieast 5,000 square feet, by one or a combination of the following: <br />a. alteration of the interior space of the dwelling, <br />b. conversion of an attic, basement, attached garage, or other previously uuinhabited portion <br />of a d�eelling or attached acccssory structure; or <br />c. addition of attached living area onto the existing dwelling. <br />The lot is approximately 20,000 squ:ire feet. The applicant will construct the accessory <br />dwelling unit behind the existing attached garage. <br />2. Each single family dwelling on a legal building lot shall not have more than one accessory <br />dwelling unit. No accessory dwclling may be located in any detached accessory structure. <br />The proposed action is for one accessory dwelling unit only. The proposed accessory <br />dwelling unit will be attached to the back of the garage and ro the s�de of of the house. <br />One of the dwelling units shall be occupicd by one or more owners of the property as the <br />o���ners peimanent and principal residence. <br />Thc owncr of the propc�ty will be required to submit a certification that he/she owns and <br />resides at the subject property. <br />4. The floor arca of the accessory dwclling unit shall not exceed 40�Io of the total Floor area of <br />thc structure, or 800 squarc feet, whichever is less. <br />Thc floor area of the proposed accessory dwelling unit is approximately 648 square feet, <br />which is less than 40�10 of the total floor area. <br />5. The total number of persons who may occupy the principal and accessory dwelling units <br />combined shall not exceed the number of persons that are defined by this Tide as a"family". <br />The applicant has agrced to this rcquirement as part of their permit application. , <br />I IJ� <br />
