Jurisdiction: The Hearing Examiner of the City of Everett has jurisdictional authority to <br />hold a hearing and to issue the decision. That authority is set forth in EMC 15.16.100. <br />Based on the above Findings of Fact, the Hearing Examiner enters the following <br />Conclusions: <br />Criteria and Standards for Review <br />EMC 19.7.020.K. The Hearing Examiner, using the review process described in EMC, <br />Title 15, Local Project Review Procedures, may allow detached accessory buildings to <br />exceed 15 feet in height, or to exceed 1,000 square feet in area, as provided herein. <br />The Hearing Examiner shall have the authority to deny an application for accessory <br />buildings which exceed 15 feet in height or a total of 1,000 square feet. The basis for <br />denial is incompatibility with the dwelling and/or neighborhood character. To make this <br />determination, the Hearing Examiner may look to such factors that include, but are not <br />limited to, view obstruction, aesthetic impact on surrounding properties and streetscape, <br />incompatible scale with dwellings on surrounding properties, and impact on <br />neighborhood character. EMC 19.7.020.K allows the Hearing Examiner to issue <br />exceptions pursuant to the provisions of EMC 19.7.020.11. <br />CONCLUSIONS BASED ON FINDINGS <br />The Applicant is the owner of the properly at 4309 Olympic Boulevard, Everett, <br />Washington. He submitted an application to allow a two-story 21 feet by 24 feet, <br />detached garage to be developed on the subject property. The proposed garage <br />would be 22 feet high. EMC 19.7.020.11 restricts the height of a detached garage <br />in an R-1, Single -'Family Detached Low Density zone to 15 feet, unless an <br />exception is allowed pursuant to EMC 19.7.020.K. (finding 1) <br />2. Based on the information provided in the record, there would be no view <br />obstructions from the proposed increase in the garage height; there would be no <br />aesthetic impact on surrounding properties or streetscape; the proposed <br />detached structure would be compatible with the existing dwa!; ng on the subject <br />property, as well as surrounding properties. There would be no impact on the <br />neighborhood character. (findings 2, 3, 4) <br />3. There have been no other height exceptions for structures on -site. (finding 6) <br />DECISION <br />Based upon the preceding Findings of Fact and Conclusions and testimony and <br />evidence submitted at the public hearing, it is hereby ordered that the Applicant is <br />granted an exception to the height restrictions for a detached garage as set forth in <br />EMC 19.7.020.11. The Applicant may constru(:( a detached garage at 4309 Olympic <br />Boulevard, Everett, Washington, to a height of 22 feet.
