City .,f Everett Planr.ing Departs�._nt <br />City Ha;l <br />Everett, Washington <br />VARIANCE PROCEDURE <br />The City of Everett Board of Ac�`::stment is authorized by law to <br />conduct hearings and make findi:!+�s and determinations therefrom <br />on applications for variances f�om the terms of the Zoning Code. <br />In granting such variances, the Board is required to consider each <br />of the following determinants: <br />-(L) - That because of special circumstances applicable to,.:.._..._._ <br />subject property, including size, shape, topography, <br />- - � • •- -•-•• location, or surroundings,,. the strict application. .to_.. _. .. . � <br />�` -' '"" the Zoning Code is found to deprive property-of rights-- •- <br />and privileges enjoyed by other properties in the vicinity <br />under identical zone classification. <br />(2) That tk:e granting of the variance will not be materially <br />detrimental to the public welfare or injurious to the <br />property or improvements in the vicinity of a zene in <br />which subject property is located. <br />(3) That the denial �= such variance request would continue <br />oz result in an uanecessary hardship to the property <br />owner, the cause of which was beyond his control. <br />:_� <br />a <br />That an variance - - - -�-� �-• <br />�� ('4) �_ y granted shall be subject -to -such <br />conditions as will assure that the adjustment thereby <br />. authorized shall not constitute a grar.t of special <br />privileges inconsistent with the limitations upon other <br />-.- .-..-- pzoperties in the vicinity and.zone.in.which the subject_:... .... . <br />property is situated. � � <br />The action by the Board of Adjustment on applications for a variance <br />is final and conclusive, unless the original applicant or an adverse <br />pazty files an appeal to the Superior Court for a i9rit of Certiorari, <br />a_Writ.of-Prohibition, or a Writ of Mandamus. . The filing of_such .... <br />appeal shall stay the ef£ective date of the order of the Board of <br />Adjustment until such time as the appeal shall have been adjudicated <br />or withdrawn. <br />REQUIFEMENTS FOR FILING <br />(1) Completion of a variance application f.orm. <br />(2) Completion of a PLOT PLAtd (to a scale not less than 1" _ <br />_ _' 100 ft.) to clearly show the dimensions of the property, <br />the location of existing and proposed buildings, signs, <br />. curbs, etc., and the permanent measurements. <br />(3) Filing fee of $15.00. <br />(4) PHOTOGRI�PHS of the property involved on a scale large <br />enough to illustrate the subjects under discussion are <br />always helpful to the IIoard of Adjustment and are suggested <br />as Exhibits with this application. <br />//._ � i�..�,. /.�: <br />r , ,,., �;;• -< .J; .. <br />� <br />�.. �'.
