On Octobnr 24. 1989, the requnet for tlu variance wae dnnied by the <br /> Noiae Control Adsinietrator of Lha City of Bverett. The reaeon for the <br /> denial was that the Appellant Lae not e�austed all of the requested <br /> seaaurea for the alleviation of the noiee in the area. <br /> 10. As a non-techoical reeson for the variance, the Appellant aulaitted that <br /> the occupant of the building, the Puget Sound Ridney Center, providee <br /> life su�taining sediml Crnataene and that ehe HVAC proridee <br /> air-coadiiiouing for the patiente. The Appellant further submitted that <br /> the occupant of the building providea dialysie treat�eat for patienta <br /> from 4:00 a.v. to 11:30 p.m. , eiz days a wenk. Man� of eheee patient� <br /> are at the center for two to three hours. Because of thie life <br /> euataining procedure, the patiente muat be in coafortable surrnundings. <br /> In order to provide confort, the building Las beea airconditioned. <br /> j 11. 1l►e Appellant �ubaitted that the Noi�e Ordinances of the City of Bverntt <br /> arn not actitely enforced, and, that they appaar to be diacrlminatingly <br /> enforcad. <br /> 12. Thn variance ras reque�ted purauant to the provislons of the Evereit <br /> � Municipal Code in effect durina Augu�t, 1989. Pureuant to F.KC <br /> i 19.70.060(A)1-4 certain criteria must be aatisfied prior to ehe issuance <br /> i of a variance. Those criteria include: <br /> A. That there are ezceptional or eztraordinary circumetances or <br /> co�itions applying to the aub�ect prnparty or as to thn intnnded <br /> use thareof� that do not apply generally to orLer properties in <br /> the s�e vicinity or aone; <br /> B. That auch variaace ia nece��ary for the prasnrvation and enjoy�ent <br /> of a subetantial prnperty right of the Appellant poseeseed bq the <br /> rnroer of other properties in thn vicinity or cone; <br /> C. That the authorisation of euch variance vill not be materially <br /> detrivmtal to the public welfare or injuriow to property in ehe <br /> vicinity or tox in vhich the prnperty ie located; <br /> D. That the granting of euch variaace vill not adverselq affect the <br /> Caspreheneive General Plaa. <br />
