Mr. Jim Zles
January 20 , 1984
Page 2
150 feet east of the two lots iri question. No improvement has
been done or is contemplated on that stretch of road, regardless
of the presence of a house on that pioperty. The road to the
west of the property is similarly undeveloped. Indeed, even with
the extra 50 faet required of Projects West, the improved road
does not connect to any other improved thoroughfare.
In essence, Pir. Crawford is forcing my client to build a 300-foot
stretch of superhighway out in the middle of '?owhere. He is
forcing them to improve the street in fcont of a piece of property
that does not belong to Projects West, which improvement aill
certainly benefit some unknown third party.
My clients rightfully question these inordinate requirements.
The project manager has offezed to execute an LID covenant to
assure logical development in time. This alternative seems much
more appropriate than the extensive improvements envisioned by
Mr. Crawfocd.
I realize that the city engineer has the discretion to order this
type of development putsuant to your municipal code, E.M.C. Title
13 , §2(B) . It appears, however, that several less severe options
are open to him pursuant to this same ordinance. Specifically.
it could be found that the existing street improvements will
adequately serve the four houses on the street; appacent.ly, a ,
good acgument could be made that this is the case. IIy ordinance,
Mr. Crawford is given a certain amount of discretion; but any
abuse of that powec should be avoided.
H
Please contact me at your earliest convenience so that we may
H r
resolve this pcoblem. '
Very truly yours, . -.
- ` l
C( t!.;!( i: \( ` `.
ANNA M.
