'17is c obsd
have required the applicant to provide in exeess of 22 feet of paving p
gutters and sidewallcs in addition to requisite transition improvements. Due to
subsequent information being provided the City, it was felt to he inappropriate to
require the e?plicant to provide full street improvemenae cu bmguttee asnd
curb, gutter, sidewalk as well es 22 feet of paving.
sidewallc requirements were eliminated provided the applicant ezecuted an LID
covenant for future MeGill Avenue street improvements.
With the exception of your client's frontage, as well as a smell transition area,
MeGill Avenue is presently improved with npproximately 18 feet of paving• Per
City Code, the Public Works Department hac the authority to require your elient to .
provide more than 18 feet of paving for purposes of providing adequate inteim
improvements. However, in this case, the Public Works Department has agreed to
eccept 18 feet of paving. In addition, your client is being requied to provide some F F
transitional improvements (50 feet of paving)• Per EMC 13.68.020(D), the Public
Works Department is required to assess these improvements in order to "provide a r F
smooth transition with existing improvements . . . ' F
C In summary, it is the position of the City that it has been reasonable in its r7

application of the ordinance requirements. Should either you or you jclnt C nt et F
pursue any further discussion concerning this mc+tter, p
 Larry Crawford at 259-8811. ,_
 :.
Very truly yours, h
  ,
° ;':
JAMF.S D.
