Cogdill: <br /> �j]V � <br /> x H�, In April of this year I contacted Gerry Ervine to work out a <br /> r �y deal concerning trees. The Etvines had asked the Barhanoviches <br /> g y H (neighbors immediately south ) if they would fell a tree which <br /> � b� was on the Barton/Barhanovich property line which shaded the <br /> � c�� Ervine 's property . 4�ne deal we struck was that if Ervine would <br /> fell a view blocking t�ee and do some trimming, we would fell <br /> y p N the tree shading theit back yard. We fell our tree in late <br /> April . Gerry says he has no current plans to fell his agreed- <br /> u�on tree. <br /> I mentioned to Gerry that we were putting in a swimming pool at <br /> about the same time as the tree conversation and asked if he <br /> �vere concerned about the cetaining wall as it was leaning <br /> �� eastward prec:ariously. He asked if when the pool were dug that <br /> �a � �he contractor could look for underground cables or deadheads <br /> and/or pull the wall uprighl. There was no discussion of wall <br /> ownership al- this point. <br /> (�.� P�ol excavation began in June at whicl� time the City of Everett <br /> physically inspected the area and decreed that the leaning wall <br /> needed to be resolved. Priur to this, Gerry and I discussed the <br /> �� wall and its ownership with no eesolution. I offered to split <br /> the cost of a survey and the cost of a new wall, if necessaey . <br /> The response was in the negative . <br /> �( ( On the evenin9 of July Sth , 1990, our pool contractoe , Chuck <br /> Beaver� and I met with GerCy to discuss action on L-tie wall . <br /> IIeavers had an engineer-approt�ed plan to correct the wall <br /> 1(�j problem. The plan was to support the wall wi.th beams from the <br /> Ervine side, excavate all eartli from our side, upright the wall , <br /> place ecology blocks on the footings , and tie the wall into the <br /> � ecolo9y blocks . If the wall could noL- be upriyhted, it would be <br /> �.� � secured with plates and cables Co the ecoioyy blucks . <br />
